Ms. Elwood noted that the only businesses which <br />have routinely strict time limitations are those establishments <br />with liquor licenses. <br /> <br />Chairperson Kreishman opened the pUblic hearing on the application. <br />There being no one present to ask questions or provide comment on <br />the application, the Chairperson declared the public hearing <br />closed. <br /> <br />After a brief discussion, Mr. Kendall stated that he thought the <br />applicant should have been present at one of the hearings for her <br />restaurant, but nevertheless moved that the Plan Commission <br />recommend approval of her application for Conditional Use Permit <br />#291 SUbject to the following conditions: <br /> <br />1. An exhaust system shall be installed or other means shall be <br />taken to prevent any food preparation odors or cooking odors <br />perceptible beyond the property line. <br /> <br />2. Signage for the restaurant shall strictly comply with the <br />provisions of the University City Sign Code. sign permits <br />shall be applied for and approved and signage installed prior <br />to occupancy. <br /> <br />3. A detailed site plan depicting a revised parking lot layout <br />and appropriate landscaping shall be submitted to the Director <br />of Planning for his review and approval prior to occupancy. <br />Striping of the parking spaces and landscaping shall be <br />installed and maintained in accordance with the approved plan. <br /> <br />4. Trash containers for patron use shall be available on the <br />premises at all times and the operator shall regularly patrol <br />the site and the neighborhood adjacent to the restaurant to <br />remove litter and debris. <br /> <br />5. Occupancy is limited to Ms. Sarah Harris doing business as <br />Fish-n-Such, a carry-out restaurant. Operation of any other <br />restaurant or operations by a different proprietor will cause <br />this permit to become null and void. <br /> <br />The motion was seconded by Mr. Foxworth and passed by a vote of 7- <br />o. <br /> <br />APPLICATION FOR CONDITIONAL USE PERMIT #292.
