<br />Plan Commission Mtlttes <br />March 27, 1991 <br />Page 6 <br /> <br />Both Mr. Marsh and Mr. Safe agreed to the addition of this eighth <br />condition and the amended motion passed by a vote of 4-0. <br /> <br />. <br /> <br />APPLICATION FOR CONDITIONAL USE PERMIT #293 - CARRY-OUT RESTAURANT <br />AT 520 MELVILLE AVENUE <br /> <br />Chairperson Kreishman informed those present that the Plan <br />Commission had scheduled a public hearing on an application for a <br />Conditional Use Permit by Mr. Shawn Jacobs doing business as <br />Cicero's Restaurant for a carry-out restaurant at 520 Melville <br />Avenue. <br /> <br />Mr. Jacobs was present to explain his application. The carry-out <br />would operate as an annex to Cicero's Restaurant at 6510 Delmar <br />Boulevard. The two restaurant areas are connected through the <br />basement area of the building. The new restaurant would offer <br />pizza and salad items for customer carry-out. Also, delivery of <br />food would be offered. Cicero's has contracted with a new <br />University City business to be known as "Room Service, Inc." which <br />would dispatch vehicles by radio when orders were ready for pick-up <br />and delivery. He urged the Plan Commission to recommend approval <br />of the delivery service over the negative recommendation of <br />Planning staff, because he believed that the elimination of the <br />delivery service would lead to more customers picking up their own <br />food and contributing to traffic congestion in the neighborhood. <br /> <br />The Chairperson called on Ms. Elwood to present the staff report on <br />the application. Ms. Elwood reviewed with Commission members the <br />documentation, including the floor plan and site drawing, submitted <br />wi th the application and detailed necessary corrections. The <br />carry-out, as proposed, would require provision for one on-site <br />parking space based on the 40 square feet of customer ordering area <br />depicted on the floor plan submitted with the application. Mr. <br />Jacobs stated in his application that one parking space is set <br />aside for his personal use in the small parking area behind the <br />building; the delivery vehicle would use this space. There is only <br />room for approximately 6 cars in the area, and any vehicles that <br />park there must use the alley to fulfill the aisle space necessary <br />to enter or exit this area. There is no guarantee that this space <br />will be consistently available for delivery vehicles. Further, <br />Zoning Code Section 45-50. 3b requires that "each required off- <br />street parking space shall open directly upon an aisle or driveway <br />of such width and design as to provide safe and efficient means of <br />access to a street or public service drive." No public parking is <br />within close range to the proposed carry-out, and it is anticipated <br />that customers would rely heavily on street parking on Melville <br />when going to pick up their orders. Mel ville is often very crowded <br />with parking, especially in the evenings. Although carry-out <br />service may be compatible with the Loop and those it serves, <br />Planning staff believes that delivery service is not compatible <br />with the area. Zoning Code Section 34-36.1 states that all ground <br />floor spaces which have frontage facing a street should be limited <br />
