.

.

Minutes - Plan Commission
Page 4
April 24, 1991

Jackie Grant, 1072 Pennsylvania, raised concern about people who carry out bar-be-que orders
and eat them as they walk down the street, discarding their trash along the way. She stated that
she did not want to pick up their trash and was opposed to issuing a conditional use permit. She
also stated her belief that the building is so ugly it would be better to tear it down.

Mr. Bell stated that he did not see the reason for paving the entire alley. In his judgement
paving a driveway to his property was all that was necessary and saw no reason to bear the cost
of all of the additional paving. He also stated that it was his understanding after meeting with
the staff he should go ahead and make improvements to the property.

Mr. Price explained the conditional use process and pointed out some of the typical conditions
that are required by the City Council.

Mr. Safe urged the Bells not to invest any more money in the building until they receive an
approval from the City Council. He stated that he could not vote to approve the application
because he did not have enough information regarding the building improvements, site
improvements or landscaping. He made it clear that even with additional information he would
not necessarily vote for approval.

Mr. Marsh moved to table and to continue the public hearing until the next meeting of the Plan
Commission in order for the applicant to provide a detailed landscaping plan, detail drawings
of the signs, information from the exhaust equipment manufacturer, plans for policing the area
and details of the fencing. Mr. Safe stated that he wants to know what the building is going to
look like. Mr. Marsh agreed to include this requirement in his motion. Ms. Ratner seconded
the motion which then passed by a vote of 5-0. Ms. Ratner then pointed out to the applicant that
photographs can be helpful in explaining their application.

REOUEST FOR EXTENSION OF CONDITIONAL USE PERMIT #276 - AGUDAS ISRAEL
OF ST. LOUIS SYNAGOGUE AT 8301-04 DELMAR BOULEVARD

Mr. Goldman distributed a letter from Mr. Mayer Klein, President of Agudas Israel, in which
he requested the matter be postponed to the May meeting of the Plan Commission since he was
confined to bed with a back injury. After a brief discussion, Mr. Safe moved that the matter
be tabled to the next meeting and that a letter be sent to Mr. Mayer requesting that he or a
representative of Agudas Israel be present at the May meeting of the Plan Commission with
adequate plans for screening the rooftop mechanical equipment in a manner that will not damage
the roofing. The motion was seconded by Mr. Marsh and was approved by a vote of 5-0.
