<br />. <br /> <br />. <br /> <br />Minutes - Plan Commission, July 24, 1991 <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />Ms. Kreishman asked Mr. Goldman if blood banks usually had physicians and registered nurses <br />on staff. Mr. Goldman replied that he did not know if it was always required but that he felt <br />it was not totally unreasonable to require it. Mr. Goldman stated that with a Conditional Use <br />Permit the applicant has the burden to prove that the use will be compatible with the surrounding <br />area. The applicant will also have to show the impact on the community as a whole and would <br />not be able to obtain a permit just on the basis of being able to comply with the zoning district's <br />permitted uses. Ms. Kreishman inquired if that was similar to pawn shops and adult bookstores. <br />Mr. Goldman stated that pawn shops are currently dealt with through licensing requirements and <br />he does not know of any special provisions for adult bookstores. <br /> <br />Ms. Ratner stated that she felt the recommendation dealt with blood banks too specifically, and <br />felt it set a standard of dealing with problems on a one-by-one basis. Mr. Marsh asked, if this <br />proposal had been on the books would it have prevented the recent blood bank applicant from <br />obtaining zoning approval? Mr. Goldman answered that the applicant would have had to have <br />proved the use's benefits to the community and its compatibility with the surrounding area. <br /> <br />Mr. Kendall suggested that applicants for blood banks should be required to obtain a stipulated <br />number of signatures from neighborhood residents prior to zoning approval. Mr. Goldman <br />replied that signatures are typical of licensing, not zoning. <br /> <br />Ms. Ratner discussed the possibility of broadening the category of blood banks to "clinics" and <br />defining clinics by the number of patrons coming in per hour. Ms. Kreishman stated that the <br />"GC" district is for the sale of goods and services and perhaps the definition of the General <br />Commercial District should be improved upon. Mr. Kendall stated that broadening the <br />definition will not discourage blood banks. <br /> <br />Mr. Goldman explained that the list of proposed conditions would not go into the ordinance but <br />would rather be the stated policy followed by the Plan Commission in approving a blood bank <br />use. Mr. Kendall stated again that he felt obtaining neighborhood signatures would be the best <br />way to discourage blood bank use. Ms. Ratner stated that the Public Hearing should suffice to <br />inform the community. Mr. Price asked whether the Plan Commission could recommend to the <br />City Council their suggestions about licensing. Mr. Goldman stated that they could. <br /> <br />Mr. Marsh moved that the following proposal for amendments to Sections 34-90 and 34-35.4 <br />of the Zoning Code be presented to the City Council: <br /> <br />Section 34-90 relating to definitions be amended by adding the following definition: <br /> <br />Blood Bank - A use which includes the collection of blood or blood components <br /> <br />5 <br />
