<br />. <br /> <br />. <br /> <br />Minules - Plan Commission, September 25, 1991 Page 2 <br /> <br />Mr. Buz Rosenberg of Bellington Realty, 7777 Bonhomme, Suite 1224, Clayton, Missouri 63105 <br />appeared as representative for applicant Ruth M. Elkins. Mr. Rosenberg explained that he is <br />under contract as purchaser and developer of the two lots. Mr. Rosenberg presented a final plat <br />of the proposed resubdivision showing the completed reference to utilitiy easements requested <br />by the City Staff. <br /> <br />Chairperson Kreishman asked Mr. Hill and Mr. Goldman for staff comments. Mr. Hill stated <br />that under Section 34-30.3(a) of the Zoning Code he made a determination that the lot width and <br />area of the resubdivided lots will be consistent with the prevailing pattern of the subdivision in <br />which the lots are located. Mr. Goldman explained that the lots will have a shared driveway <br />between them with reciprocal easements; Lot 28 will have an 8' easement on lot 27, and lot 27 <br />will have a 2' easement on lot 28. The driveway will provide access to off-street parking for <br />both lot owners. Mr. Goldman stated that this resubdivision is unusual because lot 27 has an <br />existing home that will remain. The existing home on lot 27 will have a sufficient side yard on <br />the east side after resubdivision. The western side yard of the existing home is presently <br />nonconforming but will not be changed by the resubdivision. <br /> <br />Chairperson Kreishman asked Mr. Rosenberg what his intentions for the lots were after <br />resubdivision. Mr. Rosenberg stated that he planned to rehabilitate the existing house on lot 27 <br />and improve the property for resale. He also plans to build a house on lot 28 and improve the <br />property for resale. Mr. Safe pointed out that the easements on the land would be part of the <br />deed and that the easements will work both ways. Mr. Goldman stated that the lot owners could <br />jointly abolish the easements in the future. <br /> <br />Mr. Safe moved that the Plan Commission recommend approval of the resubdivision. The <br />motion was seconded by Ms. Ratner and passed by a vote of 6 - O. <br /> <br />APPROVAL OF MINUTES <br /> <br />The Council discussed errors in the minutes from the August 28, 1991 meeting: the references <br />to Mr. Collins and Mr. Marsh should be interchanged; Ms. Ratner's abstention from discussion <br />and voting in Public Hearing for Conditional Use #301 occurred at the beginning of the hearing; <br />and the reference to a cleaners in the same "location" as the proposed use in Public Hearing for <br />Conditional Use #301 should be changed to the same "vicinity" as the proposed use. <br /> <br />Ms. Ratner moved for approval of the September 28, 1991 minutes as amended. The motion <br />was seconded by Mr. Foxworth and passed by a vote of 6 - O. <br />
