<br />. <br /> <br />. <br /> <br />April 22, 1992 Plan Commission Meeting Minutes Page 4 <br /> <br />Suzie Philpott, 7345 Westmoreland stated that she applauds the hard work that the Comforts <br />have put into clearing the property since they have moved in. However, that has made it even <br />more clear that the resubdivision should not be granted. <br /> <br />The public hearing was closed. <br /> <br />Ms. Ratner stated that she questions the interpretation of the word "lot" in the neighborhood <br />indentures since 14 out of 19 homes on that block were built differently than they were platted. <br />However, the Zoning Code for the "SR" District states: "The purpose of the "SR" district is to <br />protect and conserve areas of predominantly single-family detached residences, while allowing <br />at the same time for the construction of new units if in substantial conformance with surrounding <br />and adjacent residences." The lots that were smaller in size were not close to the property in <br />question. <br /> <br />Mr. Goldman stated that height and mass conformance are the only review for zoning, and that <br />could be waived by the City Council. <br /> <br />Mr. Safe stated that the applicants have every right to subdivide their land because it statistically <br />fits the regulations of the Zoning Code. However, the existing pattern of the neighborhood is <br />100' wide lots that go straight back. He stated that he will vote against for that reason. He <br />further stated that all the talk about trees and fences is irrelevant because Mr. Comfort could <br />take those down if he wants with or without a resubdivision. He further stated that there is no <br />cause to be alarmed about this happening again in that neighborhood because there are no other <br />double lots. <br /> <br />Ms. Kreishman stated that the progress on the lot was remarkable. She doesn't feel that the <br />proposed lots meet the prevailing pattern of the neighborhood. <br /> <br />Mr. Marsh moved that the Plan Commission recommend denial of the resubdivision. The <br />motion was seconded by Mr. Foxworth and passed by a vote of 6 - O. <br /> <br />CONTINUATION OF PUBLIC HEARING FOR CONDITIONAL USE #304 - UTILITY <br />SUBSTATION. 6220 CABANNE <br /> <br />Chairperson Kreishman informed those present that the Plan Commission had scheduled the <br />continuation of the public hearing on an application from Southwestern Bell Mobile Systems <br />represented by John P. King for Conditional Use Permit #304 for 6220 Cabanne in order to use <br />the premises as a utility substation. The Chairperson outlined the Commission's procedures and <br />criteria for reviewing conditional use permits and called for testimony from the applicant. <br /> <br />Mr. John P. King, attorney for Southwestern Bell Mobile Systems, stated that Southwestern Bell <br />Mobile Systems wished to erect a 100 foot high antenna on a parcel within the inner boundaries <br /> <br />m-4-22.plc <br />
