<br />. <br /> <br />. <br /> <br />March 24, 1993 Plan Commission Meeting Minutes Page 3 <br /> <br />Public Hearing for Conditional Use Permit #310 - Utility Substation, 1445 Woodson (rear) <br /> <br />Chairperson Marsh informed those present that the Plan Commission had scheduled the public <br />hearing on an application from James Sliger, Assistant Secretary and Director of Development <br />for Cybertel Cellular Telephone Company for Conditional Use Permit #310 for 1445 Woodson <br />(rear) in order to permit a utility substation, including a tower 100' in height. The Chairperson <br />outlined the Commission's procedures and criteria for reviewing conditional use permits and <br />called for testimony from the applicant. <br /> <br />Cybertel was represented by Craig S. Biesterfeld, Attorney at Law, of the law firm Peper, <br />Martin, Jensen, Maichel and Hetlage, 24th Floor, 720 Olive, St. Louis, MO 63101. Mr. <br />Biesterfeld presented the Commission with a preliminary site plan depicting placement of the <br />substation on the proposed lot west of Woodson road. He stated that the substation and tower <br />would be used to increase the quality of cellular telephone service in the area. The lot would <br />consist of an access easement from Woodson Road, a service shelter, an emergency generator <br />and the tower. Mr. Biesterfeld reviewed several articles, information and statements contained <br />in the packet submitted by Cybertel for the meeting. Mr. Biesterfeld stated that this particular <br />tower would service a three mile radius around the site. Gil Shmitt, Cybertel engineer, <br />explained several technical aspects concerning the tower's operation. <br /> <br />Chairperson Marsh asked Mr. Goldman to report on the staff review. Mr. Goldman stated that <br />Mr. James Sliger, Assistant Secretary and Director of Development for Cybertel Cellular <br />Telephone Company has submitted an application for a Conditional Use Permit to permit the <br />rear portion of the lot at 1445 Woodson to be used as a utility substation / cellular telephone cell <br />site including a 100' tall mono-tower. The location is as remote from concentrated residential <br />development as any site in University City. There is no indication that the access easement and <br />the tower site are paved with black-top or concrete. In all other respects, the application <br />supports a finding that the proposed Conditional use will comply with all of the standards for <br />conditional use contained in Section 34-65.4 of the Zoning Code. Mr. Goldman recommends <br />approval provided the access to the facility and the leased area are paved to comply with Section <br />34-38.7(b) of the Zoning Code. <br /> <br />The Chairperson asked for comments from the public. Ava Jamieson, 8543 Appleton, inquired <br />about the effect that the tower would have on TV and radio reception and the effect on property <br />values. Mr. Shmitt stated that because of the difference in wave frequency, there would be no <br />interference with TV and radio reception. Cybertel has a policy to address all complaints <br />concerning reception. They will send out their staff to do an investigation of the problem and <br />correct it. Mr. Biesterfeld stated that to date there has not been any reduction in property values <br />attributed to a cellular tower. Terry Lester, 8621 Orchard, stated that there is an access road <br />to the north of his property that has been causing problems due to trash and loitering. Mr. <br />Biesterfeld replied that access would not be from the road of which Mr. Lester spoke. The <br />tower's access will be located to the north off of Woodson. Mr. Lester asked when construction <br />would start. Mr. Biesterfeld replied that if the project is approved, work would probably begin <br /> <br />m-3-24.plc <br />
