.

.

2-23-94 Plan Commission Meeting Minutes Page 3

the application.

Mr. Solodar stated that when he went to the site on the previous Sunday there were 11 cars there
without license plates.

Mr. Feldman stated that some of the cars being repaired are from dealers that have not licensed
them.

The Vice Chairperson opened the public hearing and asked for testimony from the public.

Paula Brown, manager of Streetside Records, 6314 Delmar, stated that for security, health and
appearance concerns the expansion and parking change should not be approved. Streetside is
already boxed in and would be even more so if the expansion is approved. She counted 41 cars
parked on Mr. Feygelman's lot and is concerned with where they will go if parking is taken up
by the addition to the building. The added bays will cause more exhaust fumes to come toward
her building which has caused paint damage to the side of her building and is sucked into their
air through the HV AC system.

Mr. Feldman stated that the east side of Streetside's building does not have any windows so the
expansion will not affect them. Mr. Feygelman is burdened by Streetside's overflow customer
parking. Mr. Feygelman is willing to work together with the City and all the surrounding
businesses in order to resolve this situation.

Mr. Kahn asked why the limit on parking was originally passed. Mr. Goldman stated that six
cars parked outdoors overnight is one of the highest numbers permitted for such a use. Usually
they are limited to two or three.

Ms. Ratner stated that she will vote against recommending approval because the use does not
comply with the City's Comprehensive Plan.

Mr. Feldman requested that the vote be postponed until he could get more information to the
Commission. Ms. Ratner replied that the Commission would vote on the matter as presented
and that any additional information could be forwarded to the City Council prior to their
consideration.

Mr. Safe moved that the Plan Commission recommend denial of the Conditional Use Permit
amendment. The motion was seconded by Mr. Solodar and passed by a vote of 6 - 0 with Mr.
Safe, Mr. Solodar, Ms. Ratner, Ms. Peniston, Mr. Foxworth and Mr. Kahn voting "aye."

Public Hearing: Conditional Use Permit amendment #152(A) for expansion of storage
facility, 7270 Olive

m-2-23.plc
