No <br />member of the public indicated a desire to be heard and the public hearing was closed. <br /> <br />Ms. Peniston moved that the Plan Commission recommend approval of the Conditional Use <br />Permit with the following conditions: <br /> <br />1. An exhaust system shall be installed or other means shall be taken to prevent any food <br />odors from being perceptible beyond the lot lines of the property on which the restaurant <br />is located. <br /> <br />2. The hours of operation shall be limited to the hours of 7:00 a.m. to 10:00 p.m. <br /> <br />3. The use shall be limited to the restaurant/catering for carry-out operation specifically <br />indicated on the plan prepared by Crabtree Consulting entitled "Proposed Restaurant & <br />Caterer 8631 Olive," and dated 3/4/94 which was submitted as part of the application. <br /> <br />The motion was seconded by Mr. Foxworth and passed by a vote of 6 - 0 with Ms. Peniston, <br />Mr. Foxworth, Mr. Safe, Ms. Ratner, Mr. Marsh and Mr. Solodar voting "aye." <br /> <br />Rezoning of 7400 Olive, Part of Lot 21 of Central Suburbs, PA and GC to MR <br /> <br />Mr. Hill informed the Commission members that the applicant had requested that they be given <br />extra time to resubmit a revised plan addressing specific concerns voiced by the Commission at <br />the previous meeting. Due to procedural limitations the application would have to be voted on <br />before the next scheduled meeting. Therefore, the applicant asked that the application be <br />dismissed without prejudice so that they may come before the Commission at the April meeting. <br /> <br />Ms. Ratner moved that the Plan Commission dismiss the application without prejudice. The <br />motion was seconded by Mr. Solodar and passed by a vote of 6 - 0, with Ms. Ratner, Mr. <br />Solodar, Mr. Foxworth, Ms. Peniston, Mr. Marsh and Mr. Safe voting "aye." <br /> <br />Adjournment <br /> <br />Mr. Foxworth moved that the meeting be adjourned. The motion was seconded by Mr. Safe <br />and carried by a vote of 6 - O. The meeting was adjourned at 8: 15 p.m. <br /> <br />m-3-23 .plc <br />
