<br />. <br /> <br />. <br /> <br />5-25-94 Plan Commission Meeting Minutes <br /> <br />Page 2 <br /> <br />Public Hearing: Conditional Use Permit amendment #270(A) for total redevelopment of <br />the carry-out / drive-through restaurant site, 7290 Olive <br /> <br />Vice Chairperson Ratner announced that a public hearing was scheduled to hear an application <br />from Ted Hall representing Checkers c/o Ken Ryan for an amendment to Conditional Use Permit <br />#270 for total redevelopment of the carry-out / drive-through restaurant site at 7290 Olive. <br /> <br />The Vice Chairperson noted the Commission's procedures and criteria for reviewing conditional <br />use permits. She specifically stated that the Plan Commission must consider whether the use: <br />a) complies with all applicable provisions of the Zoning Code; b) at the specific location will <br />contribute to and promote the community welfare or convenience; c) will not cause substantial <br />injury to the value of neighboring property; d) complies with the overall neighborhood <br />development plan and existing zoning district provisions; and e) will provide, if applicable, off- <br />street parking and loading areas in accordance with the standards contained in the Zoning Code. <br />The Vice Chairperson called upon the applicant. <br /> <br />Ted Hall, architect, 1737 Sun Drop Dr., St. Charles, MO 63303, representing Checkers c/o <br />Ken Ryan, stated that this Checkers operation currently has three stores in the St. Louis area: <br />Lindell and Vandeventer, Hampton, south of Highway 40, and Delmar and Kingshighway. This <br />site will include the standard building design with a double drive-through and outdoor seating <br />area. Mr. Hall submitted several photographs detailing existing operations. There will be <br />landscaping and sprinklers. The first issue is the recommendation of a 16 car stacking area. <br />He believes that the figure is excessive because they will have five waiting spaces, eight for the <br />second window and if full there is an additional seven spaces. The flood plain issue should not <br />hinder the project because the size of the building is so small that it would not have much <br />impact. They could not develop the site with the building where Dubbles is located. The last <br />big issue is the necessity of having the neon strips outlining architectural features of the building. <br />They feel that it is important to maintain the corporate image and the style of the building. <br /> <br />Ken Ryan, 4101 Lindell, St. Louis, MO 63108, owner and partner in the operation stated that <br />he and T. J. Singer the other owner/partner will work with the City in every way possible. Mr. <br />Ryan gave several examples of working with neighborhoods and municipalities in the past. He <br />stated that they are adamant on keeping the neon though. <br /> <br />Mr. Hill stated that there is an ordinance which specifically prohibits outlining architectural <br />features of a building with strips or strings of lights. Mr. Ryan replied that he would apply for <br />a variance before the Board of Adjustment. Mr. Hill asked if it would mean the end of the deal <br />if such a variance was not granted. Mr. Ryan replied that it would. <br /> <br />The Vice Chairperson called on Al Goldman, Director of Planning to provide the staff report. <br />Mr. Goldman stated that Mr. Ted Hall an architect representing Checkers Restaurants, has filed <br />an application to further amend Conditional Use Permit No. 270(A) to authorize the total <br /> <br />m-5-25.plc <br />
