Landscaping shall be installed and maintained in <br />accordance with the approved plan. 7) The operator of the restaurant shall regularly police the <br />site and the area adjacent to the restaurant to remove litter and debris. 8) Trash containers for <br />patron use shall be available on the premises at all times. 9) An exhaust system shall be installed <br />and/or other means shall be taken to prevent food preparations odors or cooking odors from <br />being perceptible beyond the property line. 10) Lighting fixtures for parking lot and driveways <br />shall be shaded to prevent casting direct light on neighboring residential property. 11) All <br />curbing shall be 6" cast-in place portland cement concrete curbing. <br /> <br />The Vice Chairperson opened the public hearing and asked for testimony from the public. <br /> <br />Wilma Kennel, 1332 Purdue stated that she is concerned with safety issues pertaining to west- <br />bound Olive cars trying to enter the north entrance illegally. She further commented that cars <br />idling in the drive-through lanes will add to air pollution, there will be added litter, the sale of <br />beef contributes to the depletion of the rain forest, is high in fat, attracts a less educated patron <br />and presents a risk of ecoli infection. <br /> <br />Carol Hwang, 7306 Melrose stated that she is concerned with the volume of outdoor <br />loudspeakers. She also wants the condition of sign and building removal if the business closes <br />to remain on this permit. She feels the outdoor seating will just attract loiterers that may harass <br />the public. <br /> <br />No other members of the public indicated a desire to speak, so the public hearing portion of the <br />meeting was closed. <br /> <br />Mr. Ryan stated that they will be using surround speakers, not echo speakers, which are quieter. <br />They also have a very strict security system and will keep a close check on any loiterers. He <br />stated they that will have outdoor speakers that will be playing 50's music until 8 or 9 p.m. <br /> <br />Mr. Safe asked if there had been any major complaints about the Dubbles operation. Mr. <br />Goldman and Mr. Hill replied that they were not aware of any. <br /> <br />Ms. Peniston stated that she wished there was more buffering along the south side of the lot. <br /> <br />Ms. Ratner stated that the hours of operation should be limited. <br /> <br />The Plan Commission determined that the evidence presented to the Plan Commission supports <br />the conclusion that the proposed conditional use: a) Complies with all applicable provisions of <br />this chapter; b) At the specific location will contribute to and promote the community welfare <br />or convenience; c) Will not cause substantial injury to the value of neighboring property; d) <br /> <br />m-5-25.plc <br /> <br />
