<br />. <br /> <br />. <br /> <br />. <br /> <br />5-25-94 Plan Commission Meeting Minutes Page 5 <br /> <br />Complies with the overall neighborhood development plan and existing zoning district <br />provisions; and e) Will provide, if applicable, off-street parking and loading areas in accordance <br />with the standards contained in this chapter. Mr. Safe moved that the Plan Commission <br />recommend approval of the Conditional Use Permit amendment with the following conditions: <br /> <br />1. No building permit shall be issued for the construction of the new building until a <br />development permit is issued by the local administrator of the city flood plain <br />management ordinance. <br />2. If the business is closed for a period of 12 months, the building, trash enclosure, sign <br />supports, lighting standards and outdoor furniture shall be removed from the premises. <br />3. Signs shall comply with the University City Sign Code in every respect; and strips of <br />neon lighting shall not be used to outline architectural elements such as the canopy edges. <br />4. If vehicular access to the site can be arranged from the adjoining property on the south, <br />the driveways and parking lot layout can be changed to accommodate the new access <br />provided such changes are first reviewed and approved by the Director of Planning. <br />5. A detailed landscaping plan shall be submitted to the Director of Planning for his review <br />and approval. Landscaping shall be installed and maintained in accordance with the <br />approved plan. <br />6. The operator of the restaurant shall regularly police the site and the area adjacent to the <br />restaurant to remove litter and debris. <br />7. Trash containers for patron use shall be available on the premises at all times. <br />8. An exhaust system shall be installed and/or other means shall be taken to prevent food <br />preparations odors or cooking odors from being perceptible beyond the property line. <br />9. Lighting fixtures for parking lot and driveways shall be shaded to prevent casting direct <br />light on neighboring residential property. <br />10. All curbing shall be 6" cast-in place portland cement concrete curbing. <br />11. Volume of the outdoor speakers shall be controlled at a level to avoid disturbances in the <br />neighborhood residential areas. <br />12. Hours of operation shall be limited to between the hours of 9 a.m. and 12 midnight <br />Sunday through Thursday; and between 9 a.m. and 1 a.m. Friday and Saturday unless <br />specifically modified by the City Council. <br /> <br />The motion was seconded by Mr. Kahn and passed by a vote of 4 - 0 with all members voting <br />"aye." <br /> <br />Other Business <br /> <br />Ms. Ratner stated that she would like a copy of the flood plain map. She also feels that the <br />Comprehensive Plan should be updated. She feels a strong concern about having the <br />Commission specifically list the findings of fact that support approvals of Conditional Use <br />Permits. <br /> <br />m-5-25.plc <br /> <br />
