<br />. <br /> <br />. <br /> <br />8-24-94 Plan Commission Meeting Minutes Page 6 <br /> <br />Public Hearing: Conditional Use Permit #320, carry-out restaurant, 8237 Olive <br /> <br />Chairperson Marsh announced that a public hearing was scheduled to hear an application from <br />Tammy Pho for a Conditional Use Permit in order to allow the premises at 8237 Olive to be <br />used as a carry-out restaurant. <br /> <br />The Chairperson noted the Commission's procedures and criteria for reviewing conditional use <br />permits and amendments to them. He specifically stated that the Plan Commission must consider <br />whether the use: a) complies with all applicable provisions of the Zoning Code; b) at the <br />specific location will contribute to and promote the community welfare or convenience; c) will <br />not cause substantial injury to the value of neighboring property; d) complies with the overall <br />neighborhood development plan and existing zoning district provisions; and e) will provide, if <br />applicable, off-street parking and loading areas in accordance with the standards contained in the <br />Zoning Code. The Chairperson called upon the applicant. <br /> <br />Lee Mak, architect for Tammy Pho, 8328-R Olive, University City, MO 63132, gave an <br />overview of the proposed restaurant. He presented two options for alternative parking plans. <br /> <br />The Chairperson called on Al Goldman, Director of Planning to provide the staff report. Mr. <br />Goldman stated that the complex is served by 13 off-street parking spaces (14 if the trash <br />dumpster is relocated out of one of the parking stalls). This meets Zoning Code requirements <br />if the entire building is used for retail use. Mr. Goldman does not agree with the applicant's <br />parking analysis that three off-street parking spaces are enough for the carry out restaurant. In <br />his judgement, during peak periods as many as six parking spaces will be needed. The proposed <br />changes to the exterior of the building will improve the appearance of the corner. The applicant <br />should be advised that the awning can not contain interior lighting or it will violate the sign <br />code. The restaurant should be subject to all of the conditions that usually accompany the <br />issuance of permits for such occupancies. If the plan commission makes a finding that the <br />proposed use meets the standards for conditional use approval, he recommends that the following <br />conditions be attached: 1) Signs must conform in all respects with the provisions of the <br />University City Sign Code. 2) The operator of the restaurant shall regularly police the site and <br />the area adjacent to the restaurant to remove litter and debris. 3) Trash containers for patron <br />use shall be available on the premises at all times. 4) Adequate refuse disposal shall be provided <br />by and for the business. 5) An exhaust system shall be installed and/or other means shall be <br />taken to prevent any food preparation odors or cooking odors from being perceptible beyond the <br />lot lines of the property on which the restaurant is located. 6) Hours of operation for the <br />business shall be limited to the hours of 8:00 a.m. to 8:00 p.m. 7) Any container or facility for <br />refuse shall be located behind the building on the premises and shall not be placed in any of the <br />parking stalls that serve the building. Mr. Goldman prefers option I for the parking layout. <br /> <br />The Chairperson opened the public hearing and asked for testimony from the public.
