Agree to water and maintain <br />all the trees planted by the City. 3) If Riegert Avenue is vacated by the City, the pavement shall <br />be extended to the west wall of the building to provide space for additional parking. The paving <br />shall be completed within 120 days after the date of passage of the vacation ordinance. If the <br />City does not vacate Riegert by March 1, 1995, a portland cement curb and sidewalk shall be <br />installed at the east edge of the Riegert Avenue pavement. This work shall be completed by <br />May 31, 1995. 4) Any uses other than those normally considered religious services and <br />programs require approval of a conditional use amendment. Such uses requiring additional <br />approval include but are not limited to day care, schools, hall rental, and outdoor recreational <br />activities. <br /> <br />The Chairperson opened the public hearing and asked for testimony from the public. No <br />members of the public indicated a desire to speak, so the public hearing portion of the meeting <br />was closed. <br /> <br />Ms. Battle-Turner stated that restriping the parking lot will cost money that the church does not <br />have. <br /> <br />The Commission Members commented that the obligation for landscaping is beneficial to the <br />community. Mr. Goldman drew a site diagram on the chalk board depicting where the <br />landscaping should be installed. Ms. Ratner stated that trees are required for the landscaping <br />requirement and that Ms. Battle-Turner's offer of installation of only bushes will not meet the <br />needs of the community to reduce heat and glare and to minimize wind blowing of dust and <br />other residue and reduce oppressive visual effects of the large open parking area as required by <br />the Zoning Code. She stated this is Higher Heights third appearance before the Commission and <br />that point has been emphasized each time. <br /> <br />Mr. Safe moved that the Plan Commission recommend denial of Higher Heights Christian <br />Church's application to amend Conditional Use Permit #307(A) by waiving condition #2. The <br />motion was seconded by Ms. Ratner and passed by a vote of 7 to 0 with all members voting <br />"aye." <br /> <br />The Plan Commission determined that the evidence presented to the Plan Commission supports <br />the conclusion that the following proposed conditional use amendment: a) Complies with all <br />applicable provisions of this chapter; b) At the specific location will contribute to and promote <br />the community welfare or convenience; c) Will not cause substantial injury to the value of <br />neighboring property; d) Complies with the overall neighborhood development plan and existing <br />zoning district provisions; and e) Will provide, if applicable, off-street parking and loading areas <br />in accordance with the standards contained in the Zoning Code. Mr. Safe moved that the Plan <br />Commission recommend approval of a Conditional Use Permit Amendment subject to the <br />following conditions: <br /> <br />m-l0-26.plc <br />
