-

.

.

November 16, 1994 Plan Commission Minutes

PlIgl' ]

requirements of resubdivisions as outlined in Chapter 29 of the Municipal Code.

The Plan Commission determined that the evidence presented to the Plan Commission supports
the conclusion that the proposed final plat conforms with the minimum standards and
requirements of resubdivisions as outlined in Chapter 29 of the Municipal Code. Mr. Solodar
moved that the Plan Commission recommend to the City Council that the submitted tinal plat
as presented tonight be approved. The motion was seconded by Ms. Peniston and passed by a
vote of 4 to O.

Proposed public alley vacation for alley running north of Northmoor in the Northmoor
Park Subdivision

Mr. Hill sated that John Mulligan, Acting City Attorney has suggested that any vacations of City
property be referred to the Plan Commission for review. In doing research for the resubdi vision
located at 7001 North moor, it was discovered that an unused 15' wide alley is shown on the plat
sheets between the neighborhoods of the Northmoor Park Subdivision (along Northmoor) and
the Northmoor Subdivision (along Forsyth). On June 8, 1932 the City accepted Northmoor
Park's dedication of the 7.5' southern half of that alley. According to the Public Works
Department the northern 7.5' of the alley was never dedicated to the City by the Northmoor
Subdivision. The attached plat sheets show the development has taken place upon both sides of
the alley. Since the City only has a 7.5' strip for "public use, II it has been suggested that the
City abandon its claim on the alley. The Director of Public Works, Allan Dieckgraefe is
expected to give a positive recommendation for abandonment pending further research
concerning utility easements. Since the resubdivision matter is before the Plan Commission the
Planning Staff thought it would be prudent for the Commission to consider the planning aspects
of the abandonment at this time as well. The Planning Staff recommends that the public alley
north of Northmoor in the Northmoor Park Subdivision be vacated.

Ms. Ratner moved that the Plan Commission recommend that the City Council approve the
vacation of the public alley running north of Northmoor in the Northmoor Park Subdivision.
The motion was seconded by Mr. Solodar and passed by a vote of 4 to 0 with all members
voting "aye."

Public Hearing: Conditional Use Permit #322, Outdoor Bus Parking Facility in "PA" _
Public Activity District, 8125 Groby

Chairperson Marsh announced that a public hearing was scheduled to hear an application from
the School District of University City represented by Roger CayCe, Executive Director of
Buildings, Maintenance and Security and David Winslow, Plant Manager for a Conditional Use
Permit to allow the premises at 8125 Groby to be used as an outdoor parking facility for school
buses.

m-1l-16.plc
