<br />- <br /> <br />. <br /> <br />. <br /> <br />November 16, 1994 Plan Cummissiun Minutes <br /> <br />Page oJ <br /> <br />The Chairperson noted the Commission's procedures and criteria for reviewing conditional use <br />permits and amendments to them. He specifically stated that the Plan Commission must consider <br />whether the use: a) complies with all applicable provisions of the Zoning Code; b) at the <br />specific location will contribute to and promote the community welfare or convenience; c) will <br />not cause substantial injury to the value of neighboring property; d) complies with the overall <br />neighborhood development plan and existing zoning district provisions; and e) will provide. if <br />applicable, off-street parking and loading areas in accordance with the standards contained in the <br />Zoning Code. The Chairperson called upon the applicant. <br /> <br />Mr. CayCe explained that the School District of University City wishes to move the bus parking <br />facility from the Kingsland site to the Brittany Woods Middle School. There will be <br />approximately 24 buses parked on the site as shown in the application for the conditional use <br />permit. Mr. CayCe gave an overview of the proposal. <br /> <br />Chairperson Marsh called on Planning Director Al Goldman to provide the staff report. Mr. <br />Goldman stated that the City Council has introduced a bill to amend Section 34-40.3 of the <br />Zoning Code to allow an "outdoor bus parking facility" as a Conditional Use in the "PAil Public <br />Activity District, provided: <br /> <br />1) the primary use of the buses i.s to transport persons to or from the principal <br />buildings located on the same zoning lot and on abutting zoning lots under a <br />single ownership, <br />2) the buses are parked on a zoning lot with an area of three (3) or more acres. <br />3) the total area of the bus parking is not more than 25 % of the area of building <br />coverage of the principal building on the zoning lot, and <br />4) the bus parking is adequately screened from view from adjoining streets and <br />residential uses. <br /> <br />A second bill was introduced to define the terms "abutting II and "zoning lot" so that Section <br />34-90 will include the following definitions: <br /> <br />Abutting: Having a common border with, or being separated from such a common <br />border by a right-of-way or easement for a street, alley, pedestrian way. utilities. or <br />storm water drainage. <br /> <br />Zoning Lot: A parcel of land consisting of a single lot of record. part of a lot of record. <br />or a combination of one or more contiguous lots of record which has been or which is <br />proposed to be used, developed or built upon as a unit under single ownership or <br />control. <br /> <br />He believes the conditional use application can meet the standards of Section 34-65.4 of the <br />Zoning Code and comply with the requirements of the pending Zoning Code text amendments <br /> <br />m-11-16.plc <br /> <br />. <br /> <br />
