He specifically stated that the Plan Commission must consider whether the use: a) complies with all applicable provisions of the Zoning Code; b) at the specific location will contribute to and promote the community welfare or convenience; c) will not cause substantial injury to the value of neighboring property; d) complies with the overall neighborhood development plan and existing zoning district provisions; and e) will provide. if applicable, off-street parking and loading areas in accordance with the standards contained in the Zoning Code. The Chairperson called upon the applicant. Mr. CayCe explained that the School District of University City wishes to move the bus parking facility from the Kingsland site to the Brittany Woods Middle School. There will be approximately 24 buses parked on the site as shown in the application for the conditional use permit. Mr. CayCe gave an overview of the proposal. Chairperson Marsh called on Planning Director Al Goldman to provide the staff report. Mr. Goldman stated that the City Council has introduced a bill to amend Section 34-40.3 of the Zoning Code to allow an "outdoor bus parking facility" as a Conditional Use in the "PAil Public Activity District, provided: 1) the primary use of the buses i.s to transport persons to or from the principal buildings located on the same zoning lot and on abutting zoning lots under a single ownership, 2) the buses are parked on a zoning lot with an area of three (3) or more acres. 3) the total area of the bus parking is not more than 25 % of the area of building coverage of the principal building on the zoning lot, and 4) the bus parking is adequately screened from view from adjoining streets and residential uses. A second bill was introduced to define the terms "abutting II and "zoning lot" so that Section 34-90 will include the following definitions: Abutting: Having a common border with, or being separated from such a common border by a right-of-way or easement for a street, alley, pedestrian way. utilities. or storm water drainage. Zoning Lot: A parcel of land consisting of a single lot of record. part of a lot of record. or a combination of one or more contiguous lots of record which has been or which is proposed to be used, developed or built upon as a unit under single ownership or control. He believes the conditional use application can meet the standards of Section 34-65.4 of the Zoning Code and comply with the requirements of the pending Zoning Code text amendments m-11-16.plc .
