<br />. <br /> <br />. <br /> <br />October 25, 1995 Plan Commission Meeting Minutes <br /> <br />Page 5 <br /> <br />Ms. Glassman stated that there is potential difficulty in communication without an intercom. <br />Perhaps Shell should run tests on that. <br /> <br />Mr. Kahn stated that, without an intercom, there will not be much negative effects from the <br />proposed window. <br /> <br />Ms. Ratner asked what the hours of operation would be. Mr. Polk replied that Shell wants to <br />operate the window 24 hours per day. <br /> <br />Mr. Solodar stated that this use will probably increase traffic because it will increase <br />convenience. He thinks it will be safer for customers but does not know by how much. He <br />feels that although the residents should expect noise because of the location within which they <br />live, he is concerned with the increase in the noise level that may occur. He would not vote for <br />the application if there is an intercom system. <br /> <br />Mr. Foxworth stated that he feels the detriment to the neighbors outweighs the benefit this <br />convenience will bring to the community. He will vote against the application. <br /> <br />Ms. Ratner stated that she would vote for it because of the increase in convenience to the <br />community. If the intercom system is eliminated and the hours are limited to between 7:00 a.m. <br />and 10:00 p.m. the burden to the surrounding neighborhood will be decreased. <br /> <br />Ms. Ratner moved that the Plan Commission recommend approval of the Conditional Use Permit <br />amendment subject to the following conditions: 1) All conditions of Conditional Use Permit <br />#253(A) approved by City Council on June 10, 1988 are referenced and incorporated into this <br />permit amendment. 2) The drive through cashier facility shall not have an intercom system at <br />the window. 3) The drive through cashier facility shall only be operated between the hours of <br />7:00 a.m. and 10 p.m. The motion died for lack of a second. <br /> <br />Mr. Foxworth moved that the Plan Commission recommend denial of the Conditional Use <br />Permit amendment. The motion died for lack of a second. <br /> <br />Mr. Kahn moved that the Plan Commission recommend approval of the Conditional Use Permit <br />amendment subject to the following conditions: <br /> <br />1.
