<br />. <br /> <br />. <br /> <br />October 25, 1995 Plan Commission Meeting Minutes <br /> <br />Page 4 <br /> <br />hearing was scheduled on September 27, 1995. At that hearing the Plan Commission voted to <br />continue the meeting until tonight at the applicant's request in order to submit revised plans. <br />Vice Chairperson Solodar stated that the application from Shell Oil Co. clo Michael Tapp is for <br />an amendment to Conditional Use Permit #253 to allow the owners of the premises located at <br />7449 Olive to add a drive-through cashier's facility to the existing filling station, car wash and <br />food mart. <br /> <br />Mr. Hill distributed to the Plan Commission members and to the applicant copies of letters <br />concerning the application from: Becky and Charles Nathan, 7445 Melrose, University City, <br />Missouri 63130 and M. Elizabeth and Theodore J. Slegesky, 7430 Melrose, University City, <br />Missouri 63130. <br /> <br />The Vice Chairperson noted the Commission's procedures and criteria for reviewing conditional <br />use permits and amendments to them. The Vice Chairperson specifically stated that the Plan <br />Commission must consider whether the use: a) complies with all applicable provisions of the <br />Zoning Code; b) at the specific location will contribute to and promote the community welfare <br />or convenience; c) will not cause substantial injury to the value of neighboring property; d) <br />complies with the overall neighborhood development plan and existing zoning district provisions; <br />and e) will provide, if applicable, off-street parking and loading areas in accordance with the <br />standards contained in the Zoning Code. The Vice Chairperson called upon the applicant. <br /> <br />Robert Polk, Jr., of Farnsworth Polk, Inc., 144 West Lockwood, St. Louis, Missouri 63119 <br />stated that he was retained by Shell Oil Co. to represent them in this hearing. The firm is also <br />retained as the engineers and surveyors for the project. Mr. Polk gave an overview of the <br />revised plans for the drive-through cashier's facility. Mr. Polk reviewed a letter written by him <br />to the commission dated October 18, 1995. <br /> <br />Vice Chairperson Solodar called on Planning Director Al Goldman to provide the staff report. <br />Mr. Goldman stated that the cashier safety issue has been resolved by the pull out drawer. He <br />still feels that the visibility of customers is better for walk-up than for cars. The clerk could <br />spot a minor trying to by cigarettes better that way. If the Plan Commission recommends <br />approval for the application, the intercom system should be excluded. <br /> <br />Vice Chairperson Solodar opened the public hearing and asked for testimony from the public. <br />Linda Locke, 7340 Melrose, stated that she thinks the result of this new window would be <br />increased traffic and more noise. Cynthia Egyed, 7437 Melrose, stated that the increased traffic <br />makes her worry about childrens' safety. She is also concerned about increased noise from <br />intercoms and speakers. Jerry Sugarman, 7426 Melrose, stated that his house is right behind <br />the Shell station. He complained about the loud music currently generated by Shell's customers. <br />This new use will only increase the length of time people are waiting in their cars with the music <br />up loud. He opposes the application. No other members of the public indicated a desire to <br />speak, so the public hearing portion of the meeting was closed. <br /> <br />m-l0-25.plc <br />
