Lighting within the awning structure shall <br />be down lighting only and shall be shielded to avoid illuminating the awning itself. 2) A <br />detailed landscaping plan shall be submitted to the Director of Planning for his review and <br />approval. The landscaping plan shall be submitted by December 1, 1995 and all landscaping <br />work shall be completed by May 15, 1996. The plan shall indicate existing plants to remain and <br />indicate new planting. Landscaping shall be installed and maintained in accordance with the <br />approved plan. 3) The operator of the restaurant shall regularly police the site and the areas <br />adjacent to the site to remove litter and debris. 4) Trash containers for patron use shall be <br />available on the premises at all times. 5) Adequate refuse disposal shall be provided by and for <br />the business. 6) An exhaust system shall be installed andlor other means shall be taken to <br />prevent any food preparation odors or cooking odors from being perceptible beyond the lot lines <br />of the property on which the restaurant is located. 7) Lighting fixtures shall be shaded wherever <br />necessary to avoid casting direct light upon any property located in a residential district. 8) If <br />an outdoor eating or picnicking area is provided, it shall be directly accessible from the walkway <br />system and enclosed by a low wall or a low hedge. 9) If vehicular access to the site can be <br />arranged from the adjoining property to the south, the internal driveways and parking lot layout <br />can be changed to accommodate the new access, and the existing driveway entrance from <br />Midland to the site can be limited to outbound traffic only, provided such changes are first <br />received and approved by the Director of Planning. 10) All areas not dedicated to the building, <br />outdoor dining, vehicular traffic and parking shall be landscaped. 11) The fenced service area <br />southwest of the building shall be no larger than fourteen (14) feet by seventeen (17) feet and <br />shall be screened by landscaping. <br /> <br />Vice Chairperson Solodar opened the public hearing and asked for testimony from the public. <br />David Kennel, 1332 Purdue, stated that he is opposed to the application because there are <br />already too many fast food restaurants in the area. The use will generate trash in his <br />neighborhood from walking children who get carry-out food. Mr. Kennel drew a diagram on <br />the blackboard depicting a potential traffic problem between Waldron and Midland of westbound <br />Olive vehicles passing into the eastbound Olive lanes for approximately 25 feet in order to get <br />into the east drive-through entrance. No other members of the public indicated a desire to <br />speak, so the public hearing portion of the meeting was closed. <br /> <br />Ms. Ratner agreed that there was a potential traffic hazard at that entrance. She stated that <br />although possible trash from neighbor kids may be a problem she did not feel the threat of that <br />was serious enough to forbid a legitimate business from opening. Mr. DuBro stated that he <br />would be vigorous in his clean up efforts in the area. <br /> <br />Mr. Kennel suggested that the restaurant be limited to dine-in business only. <br /> <br />Mr. Solodar asked why the restaurant was not torn down as required in the previous conditional <br />use permit. Mr. Goldman stated that the owner of the property had several deals being put <br />together for restaurants to go into that location, of which this is the third. <br /> <br />m-l0-25.plc <br />
