Mr. DuBro <br />replied that he did. <br /> <br />Ms. Ratner stated that this location has already been shown to be a good place for this type of <br />restaurant. If there are serious traffic problems to be worked out, perhaps the traffic <br />commission should become involved. She suggested that someone investigate the number of <br />accidents that had occurred at that location when the previous restaurant was open. <br /> <br />Mr. Foxworth moved that the Plan Commission recommend approval of the Conditional Use <br />Permit subject to the following conditions: <br /> <br />1. Signs shall conform in all respects with the provisions of the University City Sign Code. <br />Lighting within the awning structure shall be down lighting only and shall be shielded <br />to avoid illuminating the awning itself. <br />2. A detailed landscaping plan shall be submitted to the Director of Planning for his review <br />and approval. The landscaping plan shall be submitted by December 1, 1995 and all <br />landscaping work shall be completed by May 15, 1996. The plan shall indicated existing <br />plants to remain and indicate new planting. Landscaping shall be installed and <br />maintained in accordance with the approved plan. <br />3. The operator of the restaurant shall regularly police the site and the areas adjacent to the <br />site to remove litter and debris. <br />4. Trash containers for patron use shall be available on the premises at all times. <br />5. Adequate refuse disposal shall be provided by and for the business. <br />6. An exhaust system shall be installed and/or other means shall be taken to prevent any <br />food preparation odors or cooking odors from being perceptible beyond the lot lines of <br />the property on which the restaurant is located. <br />7. Lighting fixtures shall be shaded wherever necessary to avoid casting direct light upon <br />any property located in a residential district. <br />8. If an outdoor eating or picnicking area is provided, it shall be directly accessible from <br />the walkway system and enclosed by a low wall or a low hedge. <br />9. If vehicular access to the site can be arranged from the adjoining property to the south, <br />the internal driveways and parking lot layout can be changed to accommodate the new <br />access, and the existing driveway entrance from Midland to the site can be limited to <br />outbound traffic only, provided such changes are first received and approved by the <br />Director of Planning. <br />10. All areas not dedicated to the building, outdoor dining, vehicular traffic and parking shall <br />be landscaped. <br />11. The fenced service area southwest of the building shall be no larger than fourteen (14) <br />feet by seventeen (17) feet and shall be screened by landscaping. <br /> <br />The motion was seconded by Ms. Ratner and passed by a vote of 5 to 0, with all members <br />voting "aye."
