February 28, 1996 Plan Commission Meeting Minutes Page 3 <br />A motion was made by Mr. Foxworth that since the proposed final plat contained the data and <br />information outlined in §29 of the University City Municipal Code, the Plan Commission shall <br />recommend approval of the Final Plat for the resubdivision of Lot 16 and 17 of the University Park <br />Subdivision if a five foot wide maintenance easement on Lot 16 is added for the benefit of the owner <br />of Lot 17 is added to the plat. The motion was seconded by Ms. Glassman and passed by a vote of <br />4 to 2. Mr. Foxworth, Ms. Glassman, Mr. Kahn and Mr. Solodar voted "aye"; Ms. Peniston and Mr. <br />Smith voted "nay." <br />Public Hearing: Conditional Use Permit #329, church, 1226 North & South <br />Chairperson Solodar announced that a public hearing was scheduled to hear an application from the <br />Divine Unity Church represented by Pastor Orlando L.Lewis. <br />The Chairperson noted the Commission's procedures and criteria for reviewing conditional use <br />permits and amendments to them. He specifically stated that the Plan Commission must consider <br />whether the use: a) complies with all applicable provisions of the Zoning Code; b) at the specific <br />location will contribute to and promote the community welfare or convenience; c) will not cause <br />substantial injury to the value of neighboring property; d) complies with the overall neighborhood <br />development plan and existing zoning district provisions; and e) will provide, if applicable, off-street <br />parking and loading areas in accordance with the standards contained in the Zoning Code. The <br />Chairperson called upon the applicant. <br />Pastor Orlando L.Lewis, 1512 Nixon, Pagedale, Missouri 63133, gave an overview of his proposal <br />to locate his church in the same commercial building as Waddell's Cleaners. He stated that the hours <br />of operation for the church will not coincide with the business hours of the cleaners. <br />Chairperson Solodar called on Planning Director Al Goldman to provide the staff report. Mr. <br />Goldman stated the applicant proposed to use a 1200 square foot space in an existing commercial <br />building for church purposes. The application indicates that signing will consist of sign hung in the <br />front window. The sign will contain only the church name and the schedule of services. The <br />application also states that outdoor activities are planned. The scope and location of such activities <br />is not indicated. Parking is adequate for the church and the adjoining business, but outdoor activities <br />could significantly reduce the amount of available parking. Also the residents of the single family <br />neighborhood on the east will be adversely effected if the outdoor activities are noisy or if they <br />involve outdoor cooking. In all other respects the application appears to meet the standards for <br />conditional use approval. He recommends approval subject to the following conditions: 1) All <br />activities shall take place inside the building and there shall be no outdoor activities at any time. 2) <br />Signing shall be limited to a single sign hung in the west window. The sign shall not exceed 12 square <br />feet in surface area. <br />Chairperson Solodar opened the public hearing and asked for testimony from the public. Natalie and <br />Edward Klamen, 1227 North & South stated they were concerned that the church parking might <br />m-2-28.plc <br /> <br />
