Septemebr 25, 1996 Plan Commission Meeting Minutes Page 3 <br />Chairperson Solodar read a letter to the commision from Ewald Winker, Jr at 8115 Delmar, <br />University City, MO 63130. <br />Rabbi Landa asked that the proposed condition concerning a perpetual easement be changed to allow <br />a normal easement because he has been told by the neighbor that he would not grant an easement in <br />perpetuity but would consider granting one for a specific period of time. <br />The Plan Commission determined that the evidence presented to the Plan Commission supports the <br />conclusion that the proposed conditional use: a) Complies with all applicable provisions of the <br />Zoning Code; b) At the specific location will contribute to and promote the community welfare or <br />convenience; c) Will not cause substantial injury to the value of neighboring property; d) Complies <br />with the overall neighborhood development plan and existing zoning district provisions; and e) Will <br />provide, if applicable, off-street parking and loading areas in accordance with the standards contained <br />in the Zoning Code. Mr. Walsh moved that the Plan Commission recommend approval of the <br />Conditional Use Permit subject to the following conditions: <br />1.The total number of occupants in the building shall be limited to a total of no more than 24 <br />persons at any time. If the applicant furnishes the city staff satisfactory evidence of a <br />recorded access easement to the rear parking area from the property to the west of the <br />applicant's site, the occupancy limit shall be increased to 30 for the period the easement is in <br />effect. The applicant agrees to allow city personnel access to the building at all reasonable <br />hours in order to monitor the number of occupants present. <br />2.No outdoor functions or activities shall be permitted, except a sukkah shall be permitted to <br />be erected for the Sukkot festival if located on the west ten feet of the rear parking area <br />provided the area is reserved for such use and the rear parking stalls are located 10 feet from <br />the east property line. <br />The motion was seconded by Mr. Price and passed by a vote of 7 to 0, with all members voting "aye." <br />Revision of the Zoning Code <br />The plan commission members discussed Articles 6 and 8 from the proposed zoning code revision. <br />The commission will discuss the proposed subdivision regulations at the next meeting. <br />Other Business <br />Mr. Solodar read a letter from Mr. Lieberman that gave an update of recent City Council activity. <br />Mr. Lieberman also mentioned that he had been contacted by several citizens that were concerned <br />because they had not received notice of a plan commission meeting concerning a map amendment. <br />Mr. Solodar stated that he will draft a reply letter to Mr. Lieberman explaining that for map <br />amendments, the Zoning Code requires a public hearing with notice to surrounding property owners <br />m-9-25.plc <br /> <br />
