Session 1735, Minutes <br />November 23, 1998 <br /> <br />AGENDA #3: SETTING PUBLIC HEARING FOR TRANSFER OF CABLE <br />TELEVISION FRANCHISE: <br /> <br />Mr. Ollendorff recommends setting 7:30 p.m. on December 21, 1998 in the Council <br />Chambers as the dme and place for a public hearing on a request to transfer the cable <br />television franchise agreement from TCI to AT&T-TCI. The request was received by <br />the City on September 10, 1998 and must be acted upon within 120 days. If Council <br />chooses not to acl on the request within 120 days, under federal law your consent will <br />be deemed granted. <br /> <br />Mr. Schoomer moved approval. Mr. Wagner seconded the motion. <br /> <br />Mr. Lieberman inq,.~ired about the manner in which this hearing would be advertised. <br />Ms. Meine said that it would be advertised in two editions of the Suburban Journal. Mr. <br />Wagner asked that it also be posted on the City's new website. Ms. Meine will do so. <br /> <br />Mr. Lieberman asked that Mr. Rose provide the council with a complaint report. Mr. <br />Rose will do so. IV!r. Rose said that the issue of the complaints will be raised in great <br />detail during the renewal of the franchise agreement, not during this transfer matter. Mr. <br />Rose said better methods of administering complaints must be developed. Responding <br />further to Mr. Lieberman, there is no threat to CALOP. Mr. Wagner thanked Mr. Rose <br />for protecting CALOP. Mr. Rose said that the existing franchise agreement would be <br />up in eight months <br /> <br />Mr. Munkel believes this entire process is a waste of time, since the FCC will see that it <br />gets approved no matter how Council feels about the matter. Mr. Rose responded that <br />the Council could cppose it and then most likely, TCI would send the matter to the <br />courts for a final decision. <br /> <br />The motion carried unanimously, except for Mr. Munkel, who voted Nay. <br /> <br />PERSONNEL REPORT: <br /> <br />Mayor Adams acknowledged the receipt of the personnel report ending the week of <br />November 20, 199~J. <br /> <br />EXECUTIVE SESSION: <br /> <br />Mr. Wagner moved that Council adjourn to Executive Session to discuss personnel at <br />7:45 p.m. in room 6 on the second floor of City Hall. Mr. Schoomer seconded motion. <br /> <br /> <br />
