Gloria Anderson, 3630 Montana, stated that she has known the <br />Griffins for a long time and vouches for them. Rudolph Oppenheim, 7561 Drexel, represents the <br />adjacent holocaust survivors’ cemetery. He states that he has no objection to the proposal. Don <br />Wylan, 7354 Melrose was concerned about asbestos removal. Bob Murry, 7415 Anrose, wanted to <br />know if this would be a lease or sale. He was informed that the property was being sold to the <br />Griffins. Martin Spizman, 8136 Stanford, stated that he is the current owner and feels this is the <br />perfect use for the property. No other members of the public indicated a desire to speak, so the <br />public hearing portion of the meeting was closed. <br />Mr. Walsh wanted the words “where possible” added to proposed condition 2. Ms. Jackson <br />discussed with Mr. Oppenheim the issue of water access. Mr. Lieberman asked if the applicants were <br />applying for tax-exempt status. Ms. Griffin replied that they will not. Ms. Peniston stated to Ms. <br />Walker that she thinks a high-quality fence would be preferable to chain link. <br />The Plan Commission determined that the evidence presented to the Plan Commission supports the <br />conclusion that the proposed conditional use: a) Complies with all applicable provisions of the <br />Zoning Code; b) At the specific location will contribute to and promote the community welfare or <br />convenience; c) Will not cause substantial injury to the value of neighboring property; d) Complies <br />with the overall neighborhood development plan and existing zoning district provisions; and e) Will <br />provide, if applicable, off-street parking and loading areas in accordance with the standards contained <br />in the Zoning Code. Mr. Walsh moved that the Plan Commission recommend approval of the <br />Conditional Use Permit subject to the following conditions: <br />1.All exterior improvements shall be completed prior to the issuance of an occupancy permit. <br />2.A 30 foot wide transitional yard shall be maintained where possible along all portions of the <br />site abutting residential lots. All parts of the transitional yard shall be densely planted with <br />a combination of evergreen and deciduous trees, and the entire perimeter of the transitional <br />yard shall be fenced with a privacy fence, all as approved by the Director of Planning. <br />3.A detailed landscaping plan shall be submitted to the Director of Planning for review by <br />September 15, 1997. The landscape material shall be installed by November 15, 1997 and <br />shall be maintained in accordance with the plan. <br />4.An easement or written agreement acceptable to both the school property owner and the <br />cemetery owner shall be recorded with the Recorder of Deeds that provides access to the <br />cemetery for funerals and for cemetery visitors and provides water for use in maintaining <br />cemetery plantings. <br />5.Exterior security lighting shall be aimed or shielded to avoid casting light on abutting <br />residential property. <br />6.Outdoor play shall be ceased by no later than 8:00 p.m. <br />The motion was seconded by Ms. Glassman and passed by a vote of 5 to 0, with all members voting <br />“aye.” <br />m-7-23.plc <br /> <br />
