July 23, 1997 Plan Commission Minutes Page 2 <br />Chairperson Solodar called on Zoning Administrator, Frank Hill to provide the staff report. Mr. Hill <br />stated that the off-street parking requirements of the Zoning Code are met by the 49 stall parking lot <br />and the service drive is adequate to meet the code requirements for off-street loading. The paved <br />area south of the building, next to the service drive is reconfigured to provide space for the storage <br />of refuse boxes and the maneuvering of service vehicles. The rear half of the site is surrounded by <br />existing single-family houses. To the greatest extent feasible, they are buffered by a 30 foot <br />transitional yard. This area should be densely planted with a mixture of deciduous and evergreen <br />trees. Care should be taken to prevent security lighting from shining into the adjoining residential <br />property. No signs are shown in the application. All signs should comply with the requirements of <br />the Zoning Code. Trees have been added to the center of the parking lot and along the north edge <br />of the parking lot. Volunteer plant growth should be removed from fences and from the west side <br />of the building and the east side of the service drive. Shrubs at the front of the building and around <br />the building entrance need replacement and some supplemental planting is also needed. The southeast <br />playground area should be fully enclosed with fencing to prevent children from entering the refuse <br />service area. The play area north of the building should be located and arranged so that none of the <br />existing large trees are removed or damaged. It appears that the operator of this facility is not a tax- <br />exempt institution. If this is inaccurate or if the status changes, the approval of the City Council will <br />be required per Municipal Code Section 18-125. The need for cemetery access and availability of <br />water to the cemetery continues to be a concern and should be addressed. There is evidence of <br />deferred maintenance on the building and grounds including such things as deteriorated blacktop <br />paving, broken curbs, bent railings, and leaning foundations for parking lot lights. The conditional <br />use permit review is limited to zoning issues, but the applicant should be aware that considerable <br />work will be required in order to meet building code and property maintenance code standards. He <br />finds that the proposed conditional use will meet the standards for approval as set out in the Zoning <br />Code, Section 34-65 if the conditional use is limited by the conditions listed below. He recommends <br />approval subject to the following conditions: 1) All exterior improvements shall be completed prior <br />to the issuance of an occupancy permit. 2) A 30 foot wide transitional yard shall be maintained along <br />all portions of the site abutting residential lots. All parts of the transitional yard shall be densely <br />planted with a combination of evergreen and deciduous trees, and the entire perimeter of the <br />transitional yard shall be fenced with a privacy fence, all as approved by the Director of Planning. <br />3) A detailed landscaping plan shall be submitted to the Director of Planning for review by <br />September 15, 1997. The landscape material shall be installed by November 15, 1997 and shall be <br />maintained in accordance with the plan. 4) An easement or written agreement acceptable to both <br />the school property owner and the cemetery owner shall be recorded with the Recorder of Deeds that <br />provides access to the cemetery for funerals and for cemetery visitors and provides water for use in <br />maintaining cemetery plantings. 5) Exterior security lighting shall be aimed or shielded to avoid <br />casting light on abutting residential property. <br />Chairperson Solodar opened the public hearing and asked for testimony from the public. Brenda <br />Walker, 7405 Anrose stated that she lives directly behind the building and would rather have a <br />cyclone fence than a privacy fence erected because she is worried about property maintenance.
