July 23, 1997 Plan Commission Minutes Page 6 <br />Chairperson Solodar opened the public hearing and asked for testimony from the public. Jarvis <br />Thurston, 7505 Teasdale, stated that he is concerned about the lighting and noise. Nancy Weisman, <br />7527 Teasdale, stated that she was opposed to the operation being open seven days per week. Don <br />Kasten, 7521 Teasdale, stated that he is against the proposal because of noise and lighting issues. <br />Jeff Klohr, 7522 Delmar, stated that he is concerned with the hours of operation being early. Joan <br />Rapp, 7520 Gannon, stated that she is concerned with noise problems. Paul Kneeland, 7527 <br />Teasdale, stated that he is concerned about an auto repair facility being there. No other members of <br />the public indicated a desire to speak, so the public hearing portion of the meeting was closed. <br />Mr. Solodar stated that the issues of the hearing are limited to the addition to the building. The use <br />is already approved for automotive repair. <br />Mr. Walsch stated that he does not support limiting the hours of operation by excluding weekends. <br />That is when most people would do an oil change. <br />Ms. Peniston asked how many cars are typically waiting for oil changes at a time. Mr. Welsch replied <br />possibly up to eight vehicles. <br />Mr. Lieberman asked if they would be offering gasoline or have overnight storage of vehicles. Mr. <br />Welsch replied no gasoline sales and no overnight storage will be required. No intercoms will be <br />needed. <br />The Plan Commission determined that the evidence presented to the Plan Commission supports the <br />conclusion that the proposed conditional use: a) Complies with all applicable provisions of the <br />Zoning Code; b) At the specific location will contribute to and promote the community welfare or <br />convenience; c) Will not cause substantial injury to the value of neighboring property; d) Complies <br />with the overall neighborhood development plan and existing zoning district provisions; and e) Will <br />provide, if applicable, off-street parking and loading areas in accordance with the standards contained <br />in the Zoning Code. Mr. Walsh moved that the Plan Commission recommend approval of the <br />Conditional Use Permit subject to the following conditions: <br />1.Construction and development shall be in substantial conformance with the site plan, floor <br />plans and elevations submitted with this application. <br />2.A detailed landscaping plan shall be submitted to the Director of Planning for review by <br />September 15, 1997. The landscape material shall be installed by November 15, 1997 and <br />shall be maintained in accordance with the plan. <br />3.Overnight parking of motor vehicles shall be limited to the area south of the building, <br />specifically excluding overnight parking between the east building wall and Hanley Road for <br />the length of the property. <br />m-7-23.plc <br /> <br />
