Mr. Self stated <br />that a 6 foot height limitation should be added to the definition of cabinet. Other changes were <br />discussed. <br />Mr. Price moved that the Plan Commission recommend that the City Council approve an amendment <br />to the text of the zoning code by addition of the following as §34-55: <br />SECTION 34-55 TELECOMMUNICATIONS ANTENNAS, TOWERS AND SUPPORT STRUCTURES <br />1.Definitions: As used in this Section the following terms shall have the meanings shown herein. <br />Antenna: Any device that transmits and/or receives electromagnetic signals for voice, data or video <br />communications purposes including, but not limited to, television, AM/FM radio, microwave, <br />cellular telephone and similar forms of communications. The term shall exclude satellite earth <br />station antennas less than 6 feet in diameter and used only for home television reception. <br />Cabinet: A structure for the protection and security of communications equipment associated with <br />one or more antennas where direct access to equipment is provided from the exterior and the <br />horizontal dimensions of which do not exceed 4 feet by 6 feet and the vertical dimensions of which <br />do not exceed a height of 6 feet. <br />Disguised Support Structure: Any free standing, man made structure designed for the support of <br />communication antennas, the presence of which is camouflaged or concealed as an architectural or <br />natural feature. Such structures may include but are not limited to clock towers, campaniles, <br />observation towers, pylon signs, water towers, light standards; flag poles and artificial trees. <br />FCC: The Federal Communication Commission. <br />Height: The vertical distance measured from the base of the structure at ground level to its highest <br />point and including the main structure and all attachments thereto. <br />Shelter: A building for the protection and security of communications equipment associated with <br />one or more antennas and where access to equipment is gained from the interior of the building. <br />Tower: A structure designed for the support of one or more antennas and including guyed towers, <br />self-supporting (lattice) towers or monopole but not disguised support structures or buildings. The <br />term shall also not include any support structure under 50 feet in height owned and operated by an <br />amateur radio operator licensed by the Federal Communication Commission. <br />Tower site: The property upon which is located antennas, communication towers, cabinets, shelters, <br />all required security fencing, screening, parking and all other facilities as may be required hereunder. <br />2.Requirements for Conditional Use Permits: <br />The following requirements shall be followed for all proposals to install, build or modify an antenna <br />or tower requiring a Conditional Use Permit. <br />a. Applications for Conditional Use Permits shall be filed and processed in <br />accordance with Section 34-65. <br />b.Findings Required: In addition to any other determinations specified by Section <br />34-65, the Planning Commission shall make findings as to the following based <br />upon evidence submitted with the application or presented during the public <br />hearing by the applicant or others. A decision by the Commission to deny an <br />application shall be based upon substantial evidence which shall be made a part <br />of the written record of the meeting at which a final decision on the application is <br />rendered.
