September 24, 1997 Plan Commission Minutes Page 6 <br />The Plan Commission determined that the evidence presented to the Plan Commission supports the <br />conclusion that the proposed conditional use: a) Complies with all applicable provisions of the <br />proposed new Zoning Code; b) At the specific location will contribute to and promote the community <br />welfare or convenience; c) Will not cause substantial injury to the value of neighboring property; d) <br />Complies with the overall neighborhood development plan and proposed zoning district provisions; <br />and e) Will provide, if applicable, off-street parking and loading areas in accordance with the <br />standards contained in the proposed new Zoning Code. Mr. Price moved that the Plan Commission <br />recommend approval of the Conditional Use Permit subject to the following conditions: <br />1.Signs shall conform in all respects with the provisions of the University City Sign Code. <br />2.A plan for deliveries and refuse storage shall be submitted to the Planning Director for his <br />review and approval. <br />3.An exhaust system shall be installed and/or other means shall be taken to prevent any food <br />preparation odors or cooking odors from being readily perceptible beyond the lot lines of the <br />property on which the restaurant is located. <br />4.If outdoor dining is desired by the applicant, a plan for outdoor dining shall submitted to the <br />City Manager for his approval and all outdoor uses shall comply with the approved plan. <br />5.The hours of operation shall be limited to the hours between 7 a.m. and 9 p.m. <br />6.The operator of the restaurant shall regularly police the site and the neighborhood adjacent to <br />the restaurant to remove litter and debris. <br />7.Delivery of supplies for the restaurant shall be limited to daylight hours. <br />The motion was seconded by Ms. Glassman and passed by a vote of 3 to 0, with Mr. Solodar, Ms. <br />Glassman and Mr. Price voting “aye” and Mr. Walsh abstaining. <br />Public Hearing: Conditional Use Permit #339, Drive-through Pharmacy Facility, 7501 - 7527 <br />Olive and 1215 - 1221 Olive Way <br />Chairperson Solodar announced that a public hearing was scheduled to hear an application from Pace <br />Properties, developers of Walgreens stores represented by Doug Huff to allow the premises at 7501 - <br />7527 Olive and 1215 - 1221 Olive Way to be used for a drive-through pharmacy facility. <br />The Chairperson noted the Commission's procedures and criteria for reviewing conditional use <br />permits and amendments to them. He specifically stated that the Plan Commission must consider <br />whether the use: a) complies with all applicable provisions of the Zoning Code; b) at the specific <br />location will contribute to and promote the community welfare or convenience; c) will not cause <br />substantial injury to the value of neighboring property; d) complies with the overall neighborhood <br />development plan and existing zoning district provisions; and e) will provide, if applicable, off-street <br />parking and loading areas in accordance with the standards contained in the Zoning Code.
