September 24, 1997 Plan Commission Minutes Page 5 <br />Helen Fletcher gave an overview of her proposal emphasizing that the kind of carry-out food they <br />will be making is gourmet food. <br />Chairperson Solodar called on Zoning Administrator, Frank B. Hill to provide the staff report. Mr. <br />Hill stated the proposed restaurant will have a major portion of its business come from carry-out but <br />will not have drive-through service. The applicant has asked that this review be considered under the <br />proposed zoning code since the current code does not provide a category for carry-out usage in the <br />“LC” - Limited Commercial District. Any approvals for this use would therefore be predicated on <br />the approval of the proposed zoning code. The proposed code has the category of “restaurant, fast <br />food” for the “LC” district which this use’s operation would fall under. Any concerns about this <br />difference should be put to rest by the fact that the “LC” district’s ban against carry-out in the current <br />code is aimed more toward a typical carry-out operation like Jack In the Box. This particular use will <br />be more akin to the Bruegger’s Bagel Shop across the street where a major portion of sales are dine- <br />in but carry-out will also be significant. Proposed Zoning Code Section 34-94.2 requires off-street <br />parking for restaurants at the rate of one space for each 50 square feet of floor area exclusive of <br />kitchen and storage areas. According to his calculations, the restaurant contains approximately 700 <br />square feet of net floor area, requiring 14 parking spaces for its use. The building has a parking lot <br />with 29 spaces. 4 of the spaces along the west side of the building do not scale as being the minimum <br />size required by proposed section 34-92.4, however automobiles seem to park in this area without <br />difficulty. The parking lot use calculations provided by the applicant are consistent with his own spot <br />checks over the past week. Therefore, the provided off-street parking should easily accommodate <br />the parking for this application as well as for existing uses in the building. This is an existing building <br />with no service areas or loading facilities. The applicant will need to work with the city staff to come <br />up with an acceptable loading and refuse storage arrangement. No information was included in the <br />application regarding signage, the control of cooking odors and outdoor dining. In all other respects <br />the proposed use appears to make satisfactory provisions concerning the conditional use review <br />criteria. He recommends approval pending approval of the proposed zoning code and subject to the <br />following conditions: 1) Signs shall conform in all respects with the provisions of the University City <br />Sign Code. 2) A plan for deliveries and refuse storage shall be submitted to the Planning Director <br />for his review and approval. 3) An exhaust system shall be installed and/or other means shall be taken <br />to prevent any food preparation odors or cooking odors from being readily perceptible beyond the <br />lot lines of the property on which the restaurant is located. 4) If outdoor dining is desired by the <br />applicant, a plan for outdoor dining shall submitted to the City Manager for his approval and all <br />outdoor uses shall comply with the approved plan. <br />Chairperson Solodar opened the public hearing and asked for testimony from the public. Eva Holley, <br />7720 Delmar, stated that she was concerned with noise, light, hours of delivery, liquor sales, trash, <br />number of employees and catering. No other members of the public indicated a desire to speak, so <br />the public hearing portion of the meeting was closed. <br />Ms. Fletcher stated that they will not be running the catering business from that location. <br />m-9-24.plc <br /> <br />
