Landscaping shall be installed and maintained in accordance with the approved plan. <br />The installation shall be completed prior to the issuance of the occupancy permit for the new <br />wing. <br />8.Exterior lighting fixtures shall be shaded wherever necessary to avoid casting direct light upon <br />any property located in a residential district. Exterior lighting shall be installed and <br />maintained in accordance with a detailed lighting plan submitted to and approved by the <br />Planning Director. <br />9.Late hour and overnight parking shall comply with a traffic and parking plan submitted to and <br />approved by the City Manager prior to the issuance of the occupancy permit for the new <br />wing. <br />10.There shall be no expansion of facilities, building of additions or new buildings, and no <br />additional drives or parking other than as shown on plans approved for this Conditional Use <br />Permit, without the approval of the City Council following a recommendation from the Plan <br />Commission after a Conditional Use public hearing. <br />11.Backer and George Avenues shall remain closed off from the site. <br />12.The site plan shall be revised to maintain a 15' transitional yard on the north side of the <br />property and a 25' transitional yard on the south side of the property. <br />13.Employees shall be prohibited from parking on the public street. <br />The motion was seconded by Ms. Glassman and passed by a vote of 4 to 0, with all members voting <br />“aye.” <br />Mr. Price wished to inform the City Council that he feels the street parking along Partridge in the area <br />of the nursing home should be reviewed by the Traffic Commission to deal with the issues of street <br />cleaning and possibly adding no parking signs along the east side of the road. <br />Public Hearing: Conditional Use Permit #338, Restaurant, Fast Food, 7700 Delmar <br />Chairperson Solodar announced that a public hearing was scheduled to hear an application from <br />Truffe’s Inc. represented by Helen Fletcher to allow the premises at 7700 Delmar to be used for a <br />restaurant, fast food. <br />The Chairperson noted the Commission's procedures and criteria for reviewing conditional use <br />permits and amendments to them. He specifically stated that the Plan Commission must consider <br />whether the use: a) complies with all applicable provisions of the Zoning Code; b) at the specific <br />location will contribute to and promote the community welfare or convenience; c) will not cause <br />substantial injury to the value of neighboring property; d) complies with the overall neighborhood <br />development plan and existing zoning district provisions; and e) will provide, if applicable, off-street <br />parking and loading areas in accordance with the standards contained in the Zoning Code.
