<br />PLAN COMMISSION <br />Minutes <br />November 12, 1997 <br />th <br />The Plan Commission held its regular meeting in the 4 Floor Meeting Room of City Hall, 6801 <br />Delmar Boulevard, University City, Missouri on November 12, 1997. The meeting commenced at <br />7:30 p.m. with Chairperson Solodar presiding. <br />Voting Members PresentVoting Members Absent <br />A. Walsh <br />Byron Price <br />Council Liaison Present <br />: Larry Lieberman, City Council Member <br />Staff Present <br />: Al Goldman, Director of Planning; Frank Hill, Zoning Administrator <br />Approval of Minutes <br />Chairperson Solodar stated that the Commission would consider approval of the minutes from the <br />October 22, 1997 meeting. Ms. Peniston moved for approval of the October 22, 1997 minutes. The <br />motion was seconded by Mr. Walsh and passed by a vote of 5 to 0 with all members voting “aye.” <br />Abrogation and Release of Deed Restriction, 8390 Delmar <br />Mr. Hill stated that a nursing home was recently approved for construction at 8390 Delmar (Lots 13 <br />and 22 of Delcrest Subdivision). The applicant has recently discovered a 1952 deed restriction placed <br />on lot 13 that limits the use to "offices of dentists, doctors, optometrists, or for general office <br />purposes,..." also allowing a drug store use (without soda fountain), storeroom for optical goods, off- <br />street parking, residential purposes and multiple residential dwellings. The restriction was to last for <br />20 years (until 1972), after which time the restriction could be "abrogated and released" provided the <br />City Council consented thereto with the "advice and consent of the City Plan Commission." <br />The applicant has asked that the restriction be removed in order to construct the nursing home. It <br />now appears that the nursing home probably will not be built. The City Manager has asked that the <br />restriction be removed, regardless, because of the possible unnecessary hindrance to future use of the <br />property. Mr. Hill stated that the purpose of the deed restriction was to require that the future use <br />of the lot conform with the general comprehensive zoning plan of the city. The current <br />comprehensive plan only mentions that at the Delmar McKnight Business District "there are no major <br />problems." As well meaning as the deed restriction may have been at the time of its creation, it is no <br />longer needed with the city's emphasis on and regulation of zoning requirements. <br />Mr. Hill stated that the lot is currently zoned "GC" - General Commercial and has been for decades. <br /> <br />
