January 28, 1998 Plan Commission Minutes Page 4 <br />a.The information required for the preliminary development plan, except that it be in its final form; <br />b.The final landscape plan with specific location of all plant material, specifying size and species. <br />2.Compliance With Approved Preliminary Development Plan: <br />The final development plan shall be in substantial compliance with the approved preliminary <br />development plan. Modifications and refinements, resulting from the final design process, may be <br />approved. In no event shall any modification of the development plan result in the following: <br />a.A change in the use or character of the development; <br /> or increase in building height <br />b.An increase in building or site coverage; <br />The Plan Commission voted 6 to 0 to recommend approval of the above referenced text amendment. <br />34-62.1 Restrictions and Limitations <br />1.Home occupations shall be operated entirely within the principal residential dwelling and/or <br />accessory buildings and shall not occupy more than twenty-five (25) percent of the total floor <br />area including basement or finished attic spaces, with the use of the dwelling for a home <br />occupation being clearly incidental and subordinate to its use for residential purposes by its <br />occupants. <br />2.The appearance of the dwelling shall not be altered in a manner which would cause the premises <br />to differ from its residential character either by the use of colors, materials, construction, <br />lighting, or the emission of sounds, noises or vibrations. <br />3.Home occupations shall be conducted by only the residents of the dwelling unit and not more <br />than one non-resident of the dwelling unit. <br />4.No outdoor storage of materials or equipment used in the home occupation shall be permitted. <br />5.No storage or display of materials, goods, supplies, or equipment related to the operation of a <br />home occupation shall be visible from the outside of the residence. <br />6.No equipment shall be utilized that creates a nuisance due to odor, vibration, heat, glare or <br />noise. <br />7.No undue impact such as overflow customer parking and noise generation. <br />8.Customer arrivals and departures only from 7:00 a.m. to 7:00 p.m. <br />Commission members stated that the proposed language was too vague and would be difficult to <br />enforce. The Plan Commission voted 6 to 0 to not recommend approval of both of the above <br />referenced text amendment. <br />34-94.2Parking Requirements <br />Dwellings, apartments (including elevator, garden,1.5 spaces for each dwelling unit, except that 2 spaces <br />and townhouse apartments)shall be provided for each dwelling unit containing <br />;plus <br />two (2) or more bedrooms visitor parking for <br />apartment dwellings with 6 or more dwelling units, at <br />the rate of 1 parking space for each 6 dwelling units <br />or fraction thereof <br />for the first 30 dwelling units and <br />1 space for each 20 additional dwelling units. <br />The Plan Commission voted 6 to 0 to recommend approval of the above referenced text amendment. <br />wpoffice\wpdata\m-1-28.plc <br /> <br />
