February 25, 1998 Plan Commission Minutes Page 6 <br />convenience; c) will not cause substantial injury to the value of neighboring property; and d) is <br />consistent with the Comprehensive Plan, neighborhood development plan (if applicable), and any <br />other official planning and development policies of the City; and e) will provide off-street parking <br />and loading areas in accordance with the standards contained in Article 7 of the Zoning Code. Mr. <br />Price moved that the Plan Commission recommend approval of the Conditional Use Permit subject <br />to the following conditions: <br />1.The approval of this application shall be contingent upon the new portion's project area being <br />rezoned to be included in the “HRO” - High Density Residential/Office District. <br />2.Common open space shall be provided in accordance with zoning requirements as may be <br />amended. <br />3.The development shall be constructed and maintained in compliance with the plans <br />submitted for this conditional use permit review. <br />4.All employee and ancillary parking for the facility shall be on-site and shall be specifically <br />excluded from the public streets. <br />5.Operation of the convenience and retail uses shall comply with the requirements of section <br />34-34.4 of the zoning code. <br />6.The parking lot shall be designed and constructed in accordance with the regulations set forth <br />in the construction requirements of 34-92.1, the vehicular access and circulation <br />requirements of 34-92.2 and the Handicap Parking requirements of 34-93.2. <br />7.Lighting of the parking areas shall comply with the requirements of section 34-93.7 of the <br />zoning code. Lighting shall be designed to be compatible with surrounding residential uses. <br />8.City council shall grant the allowable 20% reduction in the boundary requirement of section <br />34-57.3(1) as permitted in section 34-131.3. <br />9.A detailed landscaping plan shall be submitted to the Director of Planning for her/his review <br />and approval. Landscaping shall be installed and maintained in accordance with the <br />approved plan. <br />10.All conditions of the previous Conditional Use Permit #241 and amendments to CUP <br />#241(A) are incorporated herein. <br />11.Drainage must be approved by MSD and/or the University City Public Works Department. <br />12.Exhaust control for common kitchen, laundry and other facilities shall be installed or <br />maintained in order to prevent smoke and odors from being perceptible beyond the property <br />lines of the development. <br />13.Lighting shall be specifically shaded to point downward and away from abutting residential <br />uses; it shall also comply with the letter from Charles Deutsch to Mr. and Mrs. David <br />Freedman dated February 18, 1998 and incorporated herein by reference. <br />14.Landscaping shall also comply with the letter from Charles Deutsch to Mr. and Mrs. David <br />Freedman dated February 18, 1998 and incorporated herein by reference. <br />15.A comprehensive traffic study shall be performed along Barby Lane to study the possibility <br />of traffic regulations and the effect of the proposed expansion. Said study shall encompass <br />information before, during and after the expansion.
