February 25, 1998 Plan Commission Minutes Page 7 <br />16.A study shall be performed concerning zoning compliance, the aesthetic impact and the <br />developmental impact of the south elevation setback. <br />17.The applicant shall submit a plan detailing provisions for parking including construction <br />worker parking during the different phases of construction. Said plan shall be submitted to <br />the Director of Planning for her/his approval. Interim parking shall be implemented and <br />maintained in accordance with the approved plan. <br />The motion was seconded by Ms. Glassman and passed by a vote of 4 to 0, with all members voting <br />“aye.” A document of the commission’s specific written findings of fact shall be prepared by the <br />chairperson and the staff. Said findings shall be approved as an attachment to these minutes. <br />Public Hearing: Conditional Use Permit #341, Carry out restaurant with drive-through <br />facility, 6950 Olive <br />Chairperson Solodar announced that a public hearing was scheduled to consider an application from <br />Foodmaker, Inc. c/o Dennis Wozniak, 7700 Bent Branch, Ste. 130, Irving, TX 75063 represented <br />by Scott D. Fehl, Architect, Nova Group, Inc., 6312 Hazelwest Ct., Ste. 102, Hazelwood, MO 63042. <br />The application asks for permission to allow the premises at 6950 Olive to be used as a Jack In The <br />Box carry out restaurant with a drive-through facility. The application was first heard at the <br />December 10, 1997 meeting and the public hearing was adjourned and continued until this meeting <br />in order to allow the applicants to revise their site plan. <br />The Chairperson noted the Commission's procedures and criteria for reviewing conditional use <br />permits and amendments to them. He specifically stated that the Plan Commission must consider <br />whether the use: a) complies with all applicable provisions of the Zoning Code; b) at the specific <br />location will contribute to and promote the community welfare or convenience; c) will not cause <br />substantial injury to the value of neighboring property; d) complies with the overall neighborhood <br />development plan and existing zoning district provisions; and e) will provide, if applicable, off-street <br />parking and loading areas in accordance with the standards contained in the Zoning Code. The <br />Chairperson called upon the applicant. <br />Mr. Wozniak gave an overview of the proposal. He stated that they wished to stay open 24 hours <br />with both the drive-through and the dining area. At the last hearing, it was suggested that the dining <br />area be closed at 1:00 a.m., to which he would consent. He further stated that the site plan has been <br />changed in order to move the Olive entrance as far away from Bartmer as possible. Further, there <br />will be access to the Schnuck’s parking lot in the rear of the building. <br />Chairperson Solodar called on Frank B. Hill, Zoning Administrator to provide the staff report. Mr. <br />Hill stated that <br />this is the last application to be considered under the previous zoning code because <br />it was applied for prior to the new code’s adoption and the property does not require rezoning.
