Recent approvals for <br />the Schnuck complex’s and Hollywood Video’s buildings required that they be at least partially faced <br />in brick. A condition should also be added to this project in order to set a standard for the area’s <br />proposed and future development. Although the applicants show brick veneer on the plans, it is <br />proposed only in a height of two feet which can reasonably be increased to a level to be determined <br />by the Director of Planning. The electric service and the gas and electric meters should be located <br />only on the southern rear side of the building. If necessary, conditions could be set concerning hours <br />of operation. The chairperson has contacted the chief of police who indicated a preference to having <br />the dine-in service end at 1:00 a.m but had no objection to the drive-through remaining open 24- <br />hours. There is no consistent time of closing required and a survey of other conditional uses has <br />shown that each has been judged on its own merits depending on type of restaurant and proximity <br />to residential uses. The applicants have indicated that they plan to purchase the lot. Prior to the sale <br />of the land, it will need to be subdivided from the Schnuck complex property under the provisions <br />of Chapter 29 of the Municipal Code. <br />Mr. Hill stated that if appropriate conditions are attached regarding the above concerns and to cover <br />refuse container areas, litter control and odor control, the proposed conditional use will meet the <br />standards for approval. He finds that the proposed conditional use will meet the standards for <br />approval as set out in the Zoning Code, Section 34-56 if the conditional use is limited by the <br />conditions listed below. Accordingly, he recommends approval subject to the following conditions: <br />1) The operator of the restaurant shall regularly police the site and the area adjacent to the restaurant <br />to remove litter and debris. 2) Trash containers for patron use shall be available on the premises at <br />all times. Adequate refuse disposal shall be provided by and for the business. The refuse containers <br />and surroundings shall be maintained in a clean condition. 3) An exhaust system shall be installed <br />and/or other means shall be taken to prevent any food preparations odors or cooking odors from <br />being perceptible beyond the lot lines of the property on which the restaurant is located. The exhaust <br />system shall be maintained in a clean condition by regularly scheduled cleaning of the system. 4) <br />The building and all signing shall be in strict compliance with the sign requirements of the zoning <br />code. 5) Access to and from the site shall not be changed from that proposed under this conditional <br />use permit application without prior approval of the City Council under Conditional Use Permit <br />amendment. 6) The curbs required at the edges of the paving shall be portland cement concrete <br />curbs. The site plan shall be revised to reflect this requirement. 7) A detailed landscaping plan <br />complying with §34-92.6 of the newly adopted Zoning Code, shall be submitted to the Director of <br />Planning for her/his review and approval. Landscaping shall be installed and maintained in <br />accordance with the approved plan. 8) The site plan shall be revised to reflect a 4' high earth berm <br />along the Olive frontage. 9) A black metal fence, similar to that currently along the north and west <br />property lines, shall be installed and maintained along said property lines, except for the area used <br />for ingress and egress. 10) The front and side elevations shall be partially faced with brick. The <br />elevation drawings shall be revised to reflect this requirement and shall be submitted to the Director <br />of Planning for her/his review and approval. 11) Rooftop mechanical equipment shall be screened <br />from view.
