March 25, 1998 Plan Commission Minutes Page 9 <br />telecommunications services. <br />2.Construction, maintenance and operation of the tower shall be in strict compliance with <br />Section 34-64 of the University City Zoning Code. <br />The motion was seconded by Mr. Self and passed by a vote of 3 to 2, with Mr. Walsh, Mr. Self and <br />Mr. Reed voting “aye” and Mr. Solodar and Ms. Glassman voting “nay.” <br />Alternative Conditions for Conditional Use Permit 241(B), 1 McKnight Place, Mixed Use <br />Elevator Apartments <br />Mr. Hill stated that Shu Simon, City Attorney for zoning issues has reviewed the conditions for the <br />Gatesworth expansion as approved by the commission on February 25, 1998. She suggests the <br />following conditions as an alternative. She has simply reworded for clarity and/or combined the <br />added conditions with those dealings with similar subjects. <br />1.The approval of this application is contingent upon: <br />a. The parcel being rezoned to the “HRO” High Density Residential/Office Zoning District. <br />b. The City Council granting a 20% reduction in the boundary requirement of Section 34- <br />57.3(1), as authorized in Section 34-131.3-46. <br />c. The common open space requirement being amended so as to modify such requirement, <br />and the provision of such common open space for the proposed addition. <br />2.Except as heretofore modified or modified by the terms hereof, all conditions of conditional <br />use permit 241 and 241(A) and amendments thereto are met. <br />3.Except as same must be modified to comply with the conditions hereof, the addition shall <br />be constructed and maintained in compliance with the plans submitted with the application. <br />4.Operation of the convenience and retail uses shall comply with the requirements of Section <br />34-34.4 of the Zoning Code. <br />5.The parking areas shall be designed and constructed in accordance with the construction <br />requirements of Section 34.92.1, the vehicular access and circulation requirements of Section <br />34.93.2 of the Zoning Code. <br />6.All parking for the entire development, as it presently exists and the proposed addition, <br />including, without limitation, resident, guest, employee parking and parking for ancillary or <br />special events, shall be on-site and shall not be permitted on any adjoining or nearby public <br />streets. It shall be the obligation of the permittee to insure compliance with this requirement. <br />7.Lighting of all exterior areas, including all parking areas, shall comply with the requirements <br />of Section 34.93.7 of the Zoning Code, shall be designed to be compatible with surrounding <br />areas, shall be shaded to direct light downward and away from abutting uses and shall <br />comply with the terms of the letter of Charles Deutsch to Mr. and Mrs. David Freeman, dated <br />February 18, 1998, which is incorporated herein by this reference. <br />8.A detailed landscaping plan shall be submitted to the Director of Planning for his/her review <br />and approval, and shall comply with the terms of the letter of Charles Deutsch to Mr. and <br />wpoffice\wpdata\m-3-25.plc <br /> <br />
