3 <br />May 27, 1998 Plan Commission Minutes Page 3 <br />system for steam kettles. Four electric steam kettles will be used at this location. What they will <br />submit is a fume hood, which captures all the steam coming off of the kettles. They will have an <br />exhaust fan out the rear, just to augment the changes of air in the restaurant. The building that <br />the restaurant will be housed in already has a fire suppression and sprinkler system. <br />Mr. Reed asked the applicant if this had been brought to the attention of City staff. Mr. Kaufman <br />said that he was not certain, but it was marked on the blueprints. Mr. Reed said that this should <br />be brought to their attention, because he was sure staff would not include a superfluous <br />condition. Chairperson Solodar said that this was standard language. He interprets the condition <br />to mean that there should not be any preparation or cooking odors from being perceptible beyond <br />the lot lines of the property lines of the restaurant. If the steam kettle does not have this problem, <br />then Mr. Saigh would not have to worry about it. Mr. Kaufman said that if there were odors, <br />they would be pulled out through the exhaust fan in the back, not through a duct. Chairperson <br />Solodar said that it did not matter, because the language is generic enough to cover this. Once a <br />permit is issued it stays with the location, not the business. <br />Mr. Saigh asked about condition #4 concerning signage. He said that he was not familiar with <br />the sign code. Chairperson Solodar said that he would be allowed a certain square footage for <br />signs on the door and windows. Mr. Reed said that the code was very specific. Chairperson <br />Solodar told him to get in touch with Mr. Frank Hill next week about answering additional <br />questions regarding the sign code. <br />Ms. Glassman asked Mr. Saigh if he had ever considered a rear entrance for his restaurant, <br />because of the availability of rear parking. Mr. Saigh said that the customers would not be able <br />to enter from the rear because the Health department prevented traffic through the kitchen. Ms. <br />Glassman felt that the availability of a rear entrance would help hinder double parking and she <br />did realize that the plans would have to be redesigned to prohibit traffic through the kitchen. Mr. <br />Reed said that he understood that this was not a part of his business plan, but he might wish to <br />consider it. <br />Chairperson Solodar said normally they limit the operation hours of these operations and <br />suggested that the retail hours be limited to 8:00 a.m. to 10:00 p.m.. This will be condition <br />number 8. <br />Chairperson Solodar said that the zoning code, 34-37.6.1, for the Loop District says, “all grounds <br />for building space, furnished on Delmar Boulevard, shall be limited to retail sales of goods and <br />merchandise for personal consumption only. Exceptions from this limitation may be obtained by <br />granting a conditional use permit”. Chairperson Solodar wondered if the 50% requirement is the <br />right thing to do, or should a higher number be put on it. Mr. Reed asked the applicant what <br />impact a higher percentage would have on his operation. Mr. Saigh replied that if his carry out <br />service was slow, then he would have to depend more on the institutional sales, until the colder <br />months returned.
