2 <br />May 27, 1998 Plan Commission Minutes Page 2 <br />The Chairperson noted the Commission's procedures and criteria for reviewing conditional use <br />permits and amendments to them. He specifically stated that the Plan Commission must consider <br />whether the use: a) complies with all applicable provisions of the Zoning Code; b) at the <br />specific location will contribute to and promote the community welfare or convenience; c) will <br />not cause substantial injury to the value of neighboring property; and d) is consistent with the <br />Comprehensive Plan, neighborhood development plan (if applicable), and any other official <br />planning and development policies of the City; and e) will provide off-street parking and loading <br />areas in accordance with the standards contained in Article 7 of the Zoning Code. The <br />Chairperson called upon the applicant. <br />Chairperson Solodar called for the applicant, Mr. Saigh, to make his presentation. Mr. Saigh <br />stated that his intention was to open a carry out soup restaurant. There would be no seating, <br />except for a few seats out on the sidewalk. Various complimentary items, such as rolls, crackers, <br />drinks, etc. would be sold as well. He also wishes to do some institutional soup sales in addition <br />to his carry out business. The institutional sales would target schools, hospitals, restaurants, etc. <br />He understands that institutional sales could not exceed 50% of the total sales of his operation. <br />He said he sells one hundred varieties of soups. He will employ five employees. <br />Chairperson Solodar read the list of conditions as provided in the submitted staff report. 1) <br />Wholesale, non-retail and non-restaurant sales shall not exceed 50% of the gross receipts for the <br />entire business. Records shall be maintained in a manner to reflect the differing sources of <br />income. 2) The soup canning operation shall be terminated if the restaurant is closed or ceases to <br />operate for any reason. 3) The outdoor seating area shall be maintained in good condition at all <br />times. Chairs and tables shall not be stored outdoors during seasons when the area is not in use. <br />4) Signs on the premises shall conform in all respects with the provisions of the University City <br />Sign Code. 5) The operator of the restaurant shall regularly police the site and the area adjacent <br />to the restaurant to remove litter and debris. 6) Trash containers for patron use shall be available <br />on the premises at all times. Adequate refuse disposal shall be provided by and for the business. <br />The refuse containers and surroundings shall be maintained in a clean condition. 7) An exhaust <br />system shall be installed and/or other means shall be taken to prevent any food preparations <br />odors from being perceptible beyond the lot lines of the property on which the restaurant is <br />located. The exhaust system shall be maintained in a clean condition by regularly scheduled <br />cleaning of the system. <br />Chairperson Solodar asked the applicant if the conditions were acceptable. The applicant replied <br />that they were acceptable. <br />Chairperson Solodar declared the public hearing opened. <br />Mr. Al Kaufman, #14 Spoede Hills Drive, Creve Coeur, and is an employee of the Stern Fixture <br />Company.
