October 28, 1998 Plan Commission Minutes Page 3 of 3 <br />Debbie Garbow, 7947 Cornell stated that she was opposed because the applicants wish to build <br />two-story homes on the lots. Paula Rivkin, 7944 Cornell stated that she was opposed for the <br />same reason and thinks that a subdivision deed restriction may prohibit two-story construction. <br />Mr. Hill stated that this hearing concerned the subdivision of the land not the development of the <br />homes. Mr. Price asked if subdivision deed restrictions are enforced by the City. Mr. Hill <br />replied that they are not and such matters are handled between individual parties in civil court. <br />Mr. Self stated that a width dimension was incorrect and should verified and revised on the plat. <br />The applicants agreed to do so prior to submitting the plat to City Council. <br />Mr. Solodar stated that there may be a legal issue concerning a deed restriction that is outside of <br />the jurisdiction of the City and he suggested that the affected individuals contact an attorney. He <br />stated that he will vote against the proposal because he does not like the placement of two-story <br />homes between ranch-style homes. <br />Mr. Price moved that the Plan Commission recommend approval of the final plat for the <br />subdivision of 7937 Cornell, Lot 12 of the Fairbrook Subdivision with the condition that the plat <br />be revised to include the designation of the zoning district on the plat and that the width <br />dimensions be verified and revised. The motion was seconded by Mr. Self and passed by a vote <br />of 4 to 1, with Mr. Price, Mr. Self, Mr. Irons and Mr. Reed voting “aye” and Mr. Solodar voting <br />“nay.” <br />Discussion of January 20, 1999 Comprehensive Plan Revision Public Meeting <br />Mr. Walker stated that there will be public meeting on January 20, 1999 concerning the <br />Comprehensive Plan Revision. The members discussed several issues concerning the format of <br />the hearing. <br />Other Business <br />Ms. Lisa Brenner, 507 N. Central, stated that she had performed a survey of her neighborhood <br />and submitted it for consideration in revising the Comprehensive Plan. <br />Adjournment <br />Mr. Price moved for adjournment.
