March 24, 1999 Plan Commission Minutes Page 2 of 4 <br />Mr. Hill gave the staff recommendation that the application be approved per his March 19, 1999 <br />memo. <br />Ms. Peniston moved that the Plan Commission approve the final plat for the 7373 Pershing <br />Condominiums. The motion was seconded by Mr. Irons and passed by a vote of 5 to 0, with all <br />members voting “aye” (Mr. Reed was not present for this agenda item). <br />Public Hearing: Conditional Use Permit Amendment #339(A), 24 Hour Drive-through <br />Pharmacy, 7501 Olive <br />Chairperson Solodar announced that a public hearing was scheduled to hear an application from <br />Pace-Olive, LLC, represented by Art Barnes, 1401 S. Brentwood, Suite 100, St. Louis, MO <br />63144 to amend Conditional Use Permit #339(A) in order to allow the pharmacy drive-through <br />to be open 24 hours. Condition #3 of the approved permit states, “The drive through facility <br />shall be limited to the sale of pharmacy items, over-the-counter drugs and first aid supplies; and <br />the hours of operation should be limited to 7:00 a.m. to 11:00 p.m.” <br />The Chairperson noted the Commission's procedures and criteria for reviewing conditional use <br />permits and amendments to them. The Chairperson specifically stated that the Plan Commission <br />must consider whether the use: a) Complies with all applicable provisions of the University City <br />Zoning Code; b) At the specific location will contribute to and promote the community welfare <br />or convenience; c) Will not cause substantial injury to the value of neighboring property; d) Is <br />consistent with the Comprehensive Plan, neighborhood development plan (if applicable), and any <br />other official planning and development policies of the City; and e) Will provide off-street <br />parking and loading areas in accordance with the standards contained in Article 7 of the <br />University City Zoning Code. <br />Mr. Barnes gave an overview and asked that the application be approved. <br />Mr. Hill gave the staff recommendation that the application not be approved per his March 18, <br />1999 memo. <br />Chairperson Solodar opened the public hearing and asked for testimony from the public. Gary <br />Jefferson, 7522 Melrose, stated that he does not want the hours of the drive-through to be <br />extended after 11:00 p.m. Barbara Morris, 1235 Hanley, stated that she does not want the hours <br />of the drive-through to be extended after 11:00 p.m. and felt that the people who need <br />prescriptions after 11:00 p.m. could go into the store. Ruby Armstead, 7508 Melrose, stated that <br />she does not want the hours of the drive-through to be extended after 11:00 p.m. and that she was <br />concerned with the loudness of the intercom, extra noise, traffic and and music from vehicles. <br />No other members of the public indicated a desire to speak, so the public hearing portion of the <br />meeting was closed. <br />wpoffice\wpdata\m-3-24.plc <br /> <br />
