March 24, 1999 Plan Commission Minutes Page 3 of 4 <br />Mr. Price stated that he would vote against the amendment because of the store’s close proximity <br />to residential uses. <br />The Plan Commission determined that the evidence presented to the Plan Commission does not <br />support the conclusion that the proposed conditional use amendment: a) Complies with all <br />applicable provisions of the University City Zoning Code; b) At the specific location will <br />contribute to and promote the community welfare or convenience; c) Will not cause substantial <br />injury to the value of neighboring property; d) Is consistent with the Comprehensive Plan, <br />neighborhood development plan (if applicable), and any other official planning and development <br />policies of the City; and e) Will provide off-street parking and loading areas in accordance with <br />the standards contained in Article 7 of the University City Zoning Code. Mr. Price moved that <br />the Plan Commission not recommend approval of the Conditional Use Permit Amendment. The <br />motion was seconded by Ms. Peniston and passed by a vote of 5 to 0, with all members voting <br />“aye” (Mr. Reed was not present for this agenda item). <br />Public Hearing: Conditional Use Permit #349, Apartment Building in “HRO” - High <br />Density Residential / Office District with floor area ratio higher than 1.0, 8301 Delcrest <br />Chairperson Solodar announced that a public hearing was scheduled to hear an application from <br />DuPont Gardens Associates, Limited Partnership, represented by the Medve Group, 8251 <br />Maryland, St. Louis, MO 63105. The applicants request a conditional use to allow the premises <br />at 8301 Delcrest to be used as an apartment building in the “HRO” - High Density Residential / <br />Office District with a floor area ratio over 1.0. <br />The Chairperson noted the Commission's procedures and criteria for reviewing conditional use <br />permits and amendments to them. The Chairperson specifically stated that the Plan Commission <br />must consider whether the use: a) Complies with all applicable provisions of the University City <br />Zoning Code; b) At the specific location will contribute to and promote the community welfare <br />or convenience; c) Will not cause substantial injury to the value of neighboring property; d) Is <br />consistent with the Comprehensive Plan, neighborhood development plan (if applicable), and any <br />other official planning and development policies of the City; and e) Will provide off-street <br />parking and loading areas in accordance with the standards contained in Article 7 of the <br />University City Zoning Code. <br />Jacob Medve, 8251 Maryland, St. Louis, MO 63105, gave an overview and asked that the <br />application be approved. <br />Mr. Hill gave the staff recommendation that the application be approved per his March 17, 1999 <br />memo. <br />Chairperson Solodar opened the public hearing and asked for testimony from the public.
