April 28, 1999 Plan Commission Minutes Page 2 of 5 <br />Ms. Peniston moved that the Plan Commission approve the final plat for the Carlton Manor <br />Condominiums. The motion was seconded by Mr. Self and passed by a vote of 7 to 0, with all <br />members voting “aye.” <br />Public Hearing: Conditional Use Permit Amendment #350, Conveneince Store, 900 Purdue <br />Chairperson Solodar announced that a public hearing was scheduled to hear an application from <br />Terry Haney, 4545 Laclede, #218, St. Louis, MO 63108. The applicant requests a Conditional <br />Use Permit in order to operate a convenience store. <br />The Chairperson noted the Commission's procedures and criteria for reviewing conditional use <br />permits and amendments to them. The Chairperson specifically stated that the Plan Commission <br />must consider whether the use: a) Complies with all applicable provisions of the University City <br />Zoning Code; b) At the specific location will contribute to and promote the community welfare <br />or convenience; c) Will not cause substantial injury to the value of neighboring property; d) Is <br />consistent with the Comprehensive Plan, neighborhood development plan (if applicable), and any <br />other official planning and development policies of the City; and e) Will provide off-street <br />parking and loading areas in accordance with the standards contained in Article 7 of the <br />University City Zoning Code. <br />Mr. Haney gave an overview and asked that the application be approved. He also stated that he <br />would agree to the conditions as set forth in the staff recommendation. <br />Mr. Hill gave the staff recommendation that the application be approved per his April 22, 1999 <br />memo. <br />Chairperson Solodar opened the public hearing and asked for testimony from the public. Ethel <br />Meriam, 7257 Amherst stated she was concerned about litter. Randy McGee, owner of 7283 <br />Dartmouth, residence 501 Purdue, stated that he is opposed to the proposal per a letter he <br />submitted and is part of the packets sent to members. Mary Fox, 7316 Cornell, stated that she is <br />concerned with parking and safety for children in the area. Dave Dilley, 7206 Stanford, stated he <br />is concerned for the health and safety of the children in the area. Amy Kavoto, 904 Purdue, <br />stated she is concerned with parking issues. Mike Dieger, stated that he is the subdivision trustee <br />for University Park #2, and that they are concerned with cigarette sales and are opposed. No <br />other members of the public indicated a desire to speak, so the public hearing portion of the <br />meeting was closed. <br />Mr. Price stated that he would vote against the amendment because of the store’s close proximity <br />to residential uses. <br />The Plan Commission determined that the evidence presented to the Plan Commission does not <br />support the conclusion that the proposed conditional use amendment: a) Complies with all <br />wpoffice\wpdata\m-4-28.plc <br /> <br />
