April 28, 1999 Plan Commission Minutes Page 4 of 5 <br />Chairperson Solodar opened the public hearing and asked for testimony from the public. The <br />following members of the public spoke against the proposal: Lisa Brenner - 507 Central, Bruce <br />Reneke - 527 Central, Cheryl Verde - 334 Meramec, John Patterson - 511 Central, Dennis Toler - <br />547 North & South, Mike Hill - 507 Central, Fred Stover - 520 Central, and Cora Glen - 531 <br />Central. Robert Morken, 7628 Delmar spoke in favor of the proposals. No other members of the <br />public indicated a desire to speak, so the public hearing portion of the meeting was closed. <br />Mr. Solodar stated that he will not support the proposal because it does not meet the <br />requirements set forth in the zoning code for a conditional use permit and does not feel the <br />property should be rezoned or resubdivided until an acceptable proposal will be made. Among <br />other things, he stated that there were defects in the sun study, that he didn’t feel the proposal <br />will meet the requirements of the comprehensive plan, felt the applicants should have presented <br />more evidence concerning the effect on the neighboring properties, felt that the buildings were <br />too massive and too high, there are other less intrusive possibilities. <br />Ms. Peniston stated that she felt the proposal would severely impact the surrounding properties. <br />Ms. Glassman stated that the 1986 Comprehensive Plan envisioned development among many <br />streets not just North & South. If the Plan Commission is going to change the designation of that <br />area they should be fully aware of the impact of the changes. <br />Mr. Price stated that he does not support this development but does support appropriate <br />development. <br />Conditional Use Permit: The Plan Commission determined that the evidence presented to the <br />Plan Commission does not support the conclusion that the proposed conditional use: a) <br />Complies with all applicable provisions of the University City Zoning Code; b) At the specific <br />location will contribute to and promote the community welfare or convenience; c) Will not cause <br />substantial injury to the value of neighboring property; d) Is consistent with the Comprehensive <br />Plan, neighborhood development plan (if applicable), and any other official planning and <br />development policies of the City; and e) Will provide off-street parking and loading areas in <br />accordance with the standards contained in Article 7 of the University City Zoning Code. Mr. <br />Price moved that the Plan Commission not recommend approval of the Conditional Use Permit. <br />The motion was seconded by Ms. Peniston and passed by a vote of 6 to 1, with all members <br />voting “aye” except for Mr. Reed. <br />Resubdivision/Lot Consolodation: Ms. Peniston moved that the Plan Commission not approve <br />the Preliminary Plat for the properties now known as 500-546 North & South. The Commission <br />stated that the reason is that the subdividing should not take place until conditional use permit <br />issues are resolved; it is inappropriate at this point. The motion was seconded by Mr. Price and <br />passed by a vote of 6 to 0, with 1 abstention, with all members voting “aye” except that Mr. Reed <br />abstained. <br />wpoffice\wpdata\m-4-28.plc <br /> <br />
