March 22, 1999 Plan Commission Minutes Page 4 of 6 <br />The motion was seconded by Mr. Self and passed by a vote of 7 to 0, with all members voting <br />“aye.” <br />Public Hearing: Conditional Use Permit #354, Telecommunications Antenna, 8600 Delmar <br />Chairperson Glassman announced that a public hearing was scheduled to hear an application <br />from Omnipoint Communications C Operations, LLC, 12140 Woodcrest Executive Drive, Suite <br />350, St. Louis, MO 63141 represented by CIS Communications, LLC 165 N. Meramec, Suite <br />120, Clayton, MO 63105. The applicant requests a Conditional Use Permit in order to erect <br />telecommunications antennas at 8600 Delmar. <br />The Chairperson noted the Commission's procedures and criteria for reviewing conditional use <br />permits and amendments to them. The Chairperson specifically stated that the Plan Commission <br />must consider whether the use: a) Complies with all applicable provisions of the University City <br />Zoning Code; b) At the specific location will contribute to and promote the community welfare <br />or convenience; c) Will not cause substantial injury to the value of neighboring property; d) Is <br />consistent with the Comprehensive Plan, neighborhood development plan (if applicable), and any <br />other official planning and development policies of the City; and e) Will provide off-street <br />parking and loading areas in accordance with the standards contained in Article 7 of the <br />University City Zoning Code. <br />Gary Crabtree and Peter Newton of CIS Communications, LLC appeared for the applicant. Mr. <br />Crabtree gave an overview of the proposal. He asked that the application be approved. He also <br />stated that the applicant agrees to the conditions as set forth in the staff recommendation. <br />Mr. Hill gave the staff recommendation that the application be approved per his March 15, 2000 <br />memo. <br />Chairperson Glassman opened the public hearing and asked for testimony from the public. No <br />members of the public indicated a desire to speak, so the public hearing portion of the meeting <br />was closed. <br />The Plan Commission determined that the evidence presented to the Plan Commission does <br />support the conclusion that the proposed conditional use amendment: a) Complies with all <br />applicable provisions of the University City Zoning Code; b) At the specific location will <br />contribute to and promote the community welfare or convenience; c) Will not cause substantial <br />injury to the value of neighboring property; d) Is consistent with the Comprehensive Plan, <br />neighborhood development plan (if applicable), and any other official planning and development <br />policies of the City; and e) Will provide off-street parking and loading areas in accordance with <br />the standards contained in Article 7 of the University City Zoning Code.
