March 22, 1999 Plan Commission Minutes Page 5 of 6 <br />Commission determined that the proposed application complies with the special requirements for <br />telecommunications antennas as follows: existing towers are not located within the geographic <br />area necessary to meet the applicant’s engineering requirements; the proposed structure or <br />building within the applicant’s required geographic area is of sufficient height to meet system <br />engineering requirements; the existing structure has sufficient structural strength to support the <br />applicant’s proposed telecommunications antennas; the proposed telecommunications antennas <br />would not experience or cause signal interference with telecommunications antennas on existing <br />towers or structures; the fees, costs, or other contractual terms required by the owner(s) of <br />existing tower(s), structure(s), or building(s) within the required geographic area of the applicant <br />or to retrofit the existing tower(s) or structure(s) are reasonable; there are other limiting <br />conditions that render existing towers, structures or buildings within the applicant’s required <br />geographic area unsuitable; design of the tower or structure, including the telecommunications <br />antennas, shelter, and ground layout maximally reduces visual degradation and otherwise <br />complies with the provisions and intent of the zoning ordinance; the proposal minimizes the <br />number and size of the towers or structures that will be required in the geographic area <br />surrounding the proposed site; and the applicant has not failed to take advantage of available <br />shared use options provided by this ordinance or otherwise. Mr. Price moved that the Plan <br />Commission recommend approval of the Conditional Use Permit with the following conditions: <br />1.The applicant shall provide sufficient information in the building permit application that <br />shows that the existing structure has sufficient structural strength to support the <br />applicant’s proposed telecommunications antennas. <br />2.The proposed telecommunications antennas shall not cause signal interference with <br />telecommunications antennas on existing towers or structures. <br />3.All telecommunications antennas and support structures shall meet or exceed current <br />standards and regulations of the FCC and any other state or federal agency with the <br />authority to regulate communications telecommunications antennas and support <br />structures. Should such standards or regulations be amended, then the owner shall bring <br />such devices and structures into compliance with the revised standards or regulations <br />within six (6) months of the effective date of the revision unless an earlier date is <br />mandated by the controlling agency. <br />4.All telecommunications antennas and support structures shall be protected from <br />unauthorized access by appropriate security devices. <br />5.The telecommunications antennas and support structures shall not be lighted unless <br />required by the FAA or other state or federal agency with authority to regulate <br />6.The placement of advertising on antennas and support structures is prohibited. <br />K:\WPOFFICE\WPDATA\m-3-22-2000.plc.wpd <br /> <br />
