August 23, 2000 Plan Commission Minutes Page 2 of 6 <br />Mr. Hill gave the staff recommendation that the application be approved per the August 17, 2000 <br />memo. <br />Mr. Smith moved that the Plan Commission approve the final plat for the resubdivision / <br />condominiums at 7832-34 Delmar. The motion was seconded by Mr. Credit and passed by a <br />vote of 6 to 0, with all members voting “aye.” <br />Public Hearing: Conditional Use Permit Amendment #358, Drive-through Restaurant, <br />7380 Olive <br />Chairperson Glassman announced that a public hearing was scheduled to hear an application <br />from <br />the White Castle System, Inc. represented by David Sansoucie, 3199 Rverport Tech Center <br />The applicant requests a Conditional Use Permit in order to allow a <br />Dr., St. Louis, MO 63043. <br />drive-through restaurant at 7380 Olive. <br />The Chairperson noted the Commission's procedures and criteria for reviewing conditional use <br />permits and amendments to them. The Chairperson specifically stated that the Plan Commission <br />must consider whether the use: a) Complies with all applicable provisions of the University City <br />Zoning Code; b) At the specific location will contribute to and promote the community welfare <br />or convenience; c) Will not cause substantial injury to the value of neighboring property; d) Is <br />consistent with the Comprehensive Plan, neighborhood development plan (if applicable), and any <br />other official planning and development policies of the City; and e) Will provide off-street <br />parking and loading areas in accordance with the standards contained in Article 7 of the <br />University City Zoning Code. <br />Mr. Sansoucie gave an overview of the proposal. He asked that the application be approved. He <br />stated that White Castle will accept all of the proposed conditions except the condition restricting <br />the hours of operation. <br />Mr. Hill gave the staff recommendation that the application be approved per the August 17, 2000 <br />Staff Memo. <br />Chairperson Glassman opened the public hearing and asked for testimony from the public. Bill <br />Humpher, representing St. Louis Teacher’s Credit Union, 7350 Olive, stated that his organization <br />supports the proposal and is happy to see that the building will not remain vacant. George Hale, <br />White Castle Inc., 1111 Macklind, St. Louis, MO 63110 stated that it is White Castle’s policy to <br />be open 24 hours per day. Ted Slegesky, 7430 Melrose, stated that he lives in the Musick <br />neighborhood north of Olive stated that they are concerned with: early or late hour trash pickup, <br />lighting spilling over onto residential property, trash cans near exits, shrubs and trees being <br />placed in the rear transitional yard and that the neighborhood is opposed to the 24 hours of <br />operation. Richard Keeling, 7353 Melrose, stated that he is the president of the Musick <br />Neighborhood Association and that he agrees with Mr. Slegesky’s comments.
