David <br />Wright, 1000 Macklind, St. Louis, Mo 63110, stated that he is the owner of the property and that <br />White Castle is by far the best applicant to approach him about the property; it is a good <br />investment in the community and that they will be leasing the building to them. No other <br />members of the public indicated a desire to speak and the public hearing portion of the meeting <br />was closed. <br />Mr. Smith stated that he feels the hours of operation is the only issue. Mr. Hale stated that White <br />Castle would be willing to close the lobby and the dining room but would still need to have the <br />drive-through portion open. Ms. Arbogast asked when the business died down at night. Mr. hale <br />stated that between 12 a.m. and 5 a.m. business was slow. Mr. Price stated that he felt this was a <br />viable location for a 24 hour operation. Ms. Glassman stated that it would set a precedent to <br />have the building open 24 hours. Ms. Arbogast stated that she might consider it if the lobby and <br />dining areas were closed. Mr. Keeling stated that the Musick Neighborhood Association was <br />opposed to the drive-through being open 24 hours because of the increase in noise level whether <br />or not it is limited to the drive-through or the lobby. Mr. Hale stated that they will have <br />surveillance cameras outside and inside the building. Mr. price asked if White Castle would be <br />willing to have police sub-station there. Mr. Hale replied that they would and they would hire <br />securtiy guards, if necessary. Mr. price stated that the hours of operation should be extended to <br />24 hours for the drive-through, a police sub-station should be required and that lighting should <br />remain on the premises. Ms. Glassman stated that trash cans should be required at the exits and <br />the periphery of the property and that trash pick-up should be limited to the hours of 8 a.m. to 8 <br />p.m. <br />Mr. Price moved that the Plan Commission recommend approval of the Conditional Use Permit <br />with the following conditions: <br />1. The operator of the restaurant shall regularly police the site and the area adjacent to the <br />restaurant to remove litter and debris. <br />2. Trash containers for patron use shall be available on the premises at all times. Adequate <br />refuse disposal shall be provided by and for the business. The refuse containers and <br />surroundings shall be maintained in a clean condition. <br />3.An exhaust system shall be installed and/or other means shall be taken to prevent any <br />food preparations odors or cooking odors from being perceptible beyond the lot lines of <br />the property on which the restaurant is located. The exhaust system shall be maintained <br />in a clean condition by regularly scheduled cleaning of the system. <br />4.The building and all signing shall be in strict a compliance with the sign requirements of <br />the zoning code. Strips or strings of lights outlining property lines, sales area, roof lines, <br />doors, windows, wall edges or other architectural features of a building shall be <br />prohibited. <br />5.A detailed landscaping plan complying with §34-92.6 of the Zoning Code, shall be <br />submitted to the Director of Planning for review and approval in conjunction with the <br />K:\WPOFFICE\WPDATA\m-8-23-2000.plc.wpd <br /> <br />
