November 8, 2000 Plan Commission Minutes Page 2 of 6 <br />Mr. Credit moved that the Plan Commission approve the application for rezoning / map <br />amendment of 8654 Barby Lane from “SR” - Single Family Residential District to “HRO” - High <br />Density Residential / Office District. final plat for the resubdivision / condominium at 7952- 54 <br />Delmar (even). The motion was seconded by Mr. Smith and passed by a vote of 5 to 0, with all <br />members voting “aye.” <br />Public Hearing: Conditional Use Permit Amendment #295C, Nursing Home Facility, 8654 <br />Barby Lane and 2 McKnight Place <br />Chairperson Glassman announced that a public hearing was scheduled to hear an application <br />from Deutsch Family Investments, LLC represented by Charles Deutsch, One McKnight Place, <br />University City, MO 63124.The applicant requests a Conditional Use Permit in order to allow a <br /> <br />nursing home home facility at 8654 Barby Lane and 2 McKnight Place. <br />The Chairperson noted the Commission's procedures and criteria for reviewing conditional use <br />permits and amendments to them. The Chairperson specifically stated that the Plan Commission <br />must consider whether the use: a) Complies with all applicable provisions of the University City <br />Zoning Code; b) At the specific location will contribute to and promote the community welfare <br />or convenience; c) Will not cause substantial injury to the value of neighboring property; d) Is <br />consistent with the Comprehensive Plan, neighborhood development plan (if applicable), and any <br />other official planning and development policies of the City; and e) Will provide off-street <br />parking and loading areas in accordance with the standards contained in Article 7 of the <br />University City Zoning Code. <br />Mr. Deutsch gave an overview of the proposal. He asked that the application be approved. <br />Mr. Hill gave the staff recommendation that the application be approved per the October 31, <br />2000 Staff Memo. <br />Chairperson Glassman opened the public hearing and asked for testimony from the public. <br />Daniel Talonn, 8661 Barby Lane, stated that he was concerned with street parking on Barby, that <br />there should be landscaping on the north side of the property and wanted to know how medical <br />waste was handled. Beth West, 8706 Teasdale, stated she was concerned with the height of the <br />building and the additional traffic on Barby. Tom Reiling, 8651 Barby, stated that he was <br />concerned with the excessive traffic coming to and from the facility, the number of emergency <br />vehicles and the light that would be produced by the facility. Georgia Reiling, 8651 Barby stated <br />that she was concerned with the lighting of the facility. Nettie Union, 8660 Barby, stated that she <br />lives directly to the west of the proposed facility and she was concerned with how her view <br />would change, she wanted to know when construction would begin and end, she wanted to know <br />what landscaping would go in between her house and the facility, stated that there was a problem <br />with people coming into the intersection by the stop sign at Barby and she stated that she and her <br />family are bothered by asthma and wanted to know what could be done to reduce dust.
