March 28, 2001 Plan Commission Minutes Page 2 of 6 <br />Mr. Credit moved that the Plan Commission approve the final plat for the resubdivision / <br />condominium at 7937-39 Delmar (odd). The motion was seconded by Mr. Smith and passed by a <br />vote of 5 to 0, with all members voting “aye.” <br />Public Hearing: Conditional Use Permit #403, Non-retail Use (tatoo and body piercing service) <br />in “CC” District, 6309 Delmar <br />Chairperson Glassman announced that a public hearing was scheduled to hear an application from <br />Iron Age Studios, Inc. c/o Mark Andrews and Brad Fink, 6606A Delmar, University City, MO 63130. <br />The applicant requests a Conditional Use Permit in order to operate a non-retail business on the <br />ground floor facing Delmar in the “CC” - Core Commercial District at 6309 Delmar. <br />The Chairperson noted the Commission's procedures and criteria for reviewing conditional use <br />permits and amendments to them. The Chairperson specifically stated that the Plan Commission <br />must consider whether the use: a) Complies with all applicable provisions of the University City <br />Zoning Code; b) At the specific location will contribute to and promote the community welfare or <br />convenience; c) Will not cause substantial injury to the value of neighboring property; d) Is <br />consistent with the Comprehensive Plan, neighborhood development plan (if applicable), and any <br />other official planning and development policies of the City; and e) Will provide off-street parking <br />and loading areas in accordance with the standards contained in Article 7 of the University City <br />Zoning Code. <br />Mr. Andrews and Mr. Fink gave an overview of the proposal. They asked that the application be <br />approved. <br />Mr. Hill gave the staff recommendation that the application be approved per the March 20, 2001 Staff <br />Memo. <br />Joe Edwards - 6309 McPherson, Jim Russel - 6235 Delmar, Glen Stallings - 1726 Preston Pl. 63104, <br />and Carol Crudden - 7425 Shaftesbury all spoke in favor of the application. Letters from: Chris <br />Dougher - Good Works 6323 Delmar, Paula Brud-Brown - Streetside Records 6314 Delmar, Lew <br />Prince - Vintage Vinyl 6610 Delmar and Blaine Parada - Faru 6329 Delmar, all in favor of the <br />application. No other members of the public wished to speak and the Public Hearing was closed. <br />The Plan Commission determined that the evidence presented to the Plan Commission does support <br />the conclusion that the proposed conditional use amendment: a) Complies with all applicable <br />provisions of the University City Zoning Code; b) At the specific location will contribute to and <br />promote the community welfare or convenience; c) Will not cause substantial injury to the value of <br />neighboring property; d) Is consistent with the Comprehensive Plan, neighborhood development plan <br />(if applicable), and any other official planning and development policies of the City; and e) Will <br />provide off-street parking and loading areas in accordance with the standards contained in Article 7 of <br />the University City Zoning Code.
