March 28, 2001 Plan Commission Minutes Page 3 of 6 <br />of the Conditional Use Permit without conditions. The motion was seconded by Ms. Arbogast and <br />passed by a vote of 5 to 0 with all members voting “aye.” <br />Public Hearing: Conditional Use Permit #402, office and student center for church in “PA” <br />District, 7023 Forsyth <br />Chairperson Glassman announced that a public hearing was scheduled to hear an application from <br />The Episcopal Diocese of Missouri c/o Harold Burroughs, Attorney, 211 N. Broadway, Ste. 3600, St. <br />Louis, MO 63102. The applicant requests a Conditional Use Permit in order to operate an office and <br />student center in the PA - Public activity District at 7023 Forsyth. <br />The Chairperson noted the Commission's procedures and criteria for reviewing conditional use <br />permits and amendments to them. The Chairperson specifically stated that the Plan Commission <br />must consider whether the use: a) Complies with all applicable provisions of the University City <br />Zoning Code; b) At the specific location will contribute to and promote the community welfare or <br />convenience; c) Will not cause substantial injury to the value of neighboring property; d) Is <br />consistent with the Comprehensive Plan, neighborhood development plan (if applicable), and any <br />other official planning and development policies of the City; and e) Will provide off-street parking <br />and loading areas in accordance with the standards contained in Article 7 of the University City <br />Zoning Code. <br />David Fedder, Co-Attorney for Mr. Burroughs, 36 Moorwood, 63141, stated that Mr. Burroughs was <br />unable to attend and that he was representing the Episcopal Diocese. He asked the application be <br />approved. Reverend Kinman, 1075 Midland, 63130 asked that the application be approved. <br />Mr. Hill gave the staff recommendation that the application be approved per the March 20, 2001 Staff <br />Memo. <br />Frank Reedy - 7041 Forsyth spoke against the proposal, Joe Dennigan - 7031 Forsyth spoke against <br />the proposal, Dietlinde Weisneski - 7020 Lindell expressed concerns about the proposal. No other <br />members of the public wished to speak and the Public Hearing was closed. <br />The Plan Commission determined that the evidence presented to the Plan Commission does support <br />the conclusion that the proposed conditional use amendment: a) Complies with all applicable <br />provisions of the University City Zoning Code; b) At the specific location will contribute to and <br />promote the community welfare or convenience; c) Will not cause substantial injury to the value of <br />neighboring property; d) Is consistent with the Comprehensive Plan, neighborhood development plan <br />(if applicable), and any other official planning and development policies of the City; and e) Will <br />provide off-street parking and loading areas in accordance with the standards contained in Article 7 of <br />the University City Zoning Code.
